<br /> 19 <br /> <br />Mr. Wheeler said that originally the proposal was to include the donor list on the <br />Monument, and that was the idea the BAR did not like, and they approved the alternative <br />instead. <br /> <br /> Mr. Schilling said at least one member of the BAR did not like the idea of a donor <br />list at all. <br /> <br /> Mr. Lynch expressed concern about the orientation of the signs, and their <br />blocking the view along with the already visually imposing Monument. <br /> <br /> Mr. Wheeler said people will see the signs and the rules as their approach the <br />Monument. He said if they are oriented the other way they will not be as visible. <br /> <br /> Mr. Lynch also expressed concern about the donor sign. <br /> <br /> Mr. Wheeler noted that funds were raised entirely from the private sector for the <br />Monument and they were told that the donations would be formally recognized at the <br />Monument. <br /> <br /> Ms. Hamilton said she has no problem with the donor recognition signs. <br /> <br /> Mr. Wheeler said the idea of the donor list was discussed at the BAR meeting and <br />at least one time at a Council meeting. <br /> <br /> On motion by Mr. Caravati, seconded by Ms. Hamilton, the lease agreement was <br />amended to authorize the signs on the poles and to clarify that no special event permit is <br />required by the following vote. Ayes: Dr. Brown, Mr. Caravati, Ms. Hamilton. Noes: <br />Mr. Schilling. Abstaining: Mr. Lynch. <br /> <br />WHEREAS <br />, in March 2001 the City Council of the City of Charlottesville, <br />Virginia passed a Resolution of its intent to lease property adjacent to City Hall for a First <br />Amendment monument (“2001 Resolution”); and <br /> <br />WHEREAS <br /> , the 2001 Resolution stated that the “leased premises” would be <br />approximately 2,000 square feet in area; and <br /> <br />WHEREAS <br /> , on May 25, 2005 the City and the Thomas Jefferson Center for the <br />Protection of Free Expression entered into a written lease agreement consistent with the <br />terms specified within the 2001 Resolution (“2005 Lease”), and the 2005 Lease describes <br />the “leased premises” as being a space described on a certain Exhibit A to the 2005 <br />Lease, within which is contained an area of 121-square-feet consisting of the footprint for <br />the First Amendment monument itself. The total square-footage of the space depicted on <br />Exhibit A as being subject to the lease is approximately 2,350 square feet; and <br /> <br />WHEREAS <br /> , the Tenant under the 2005 Lease seeks permission to utilize space <br />on certain lamp posts located within the 2,350 square-foot leased premises, consistent <br />with the signage provisions of the 2001 Resolution; <br /> <br />NOW, THEREFORE <br /> , be it resolved by the Charlottesville City Council: <br /> <br />THAT <br /> the City Manager is authorized to execute an Addendum to the 2005 <br />Lease, to clarify that the area of the “leased premises” described in Exhibit A to the 2005 <br />Lease consists of approximately 2,350 square feet (including the footprint of the First <br />Amendment monument); <br /> <br />AND FURTHER THAT <br /> the City Manager is authorized to include within an <br />Addendum to the 2005 Lease a provision authorizing the use of space on certain lamp <br />posts located within the leased premises certain signs relating to the First Amendment <br />monument, consistent with the City Manager’s authority under §34-1027 of the City <br />Code. <br /> <br /> <br />
