<br /> 20 <br />RESOLUTION <br />: AUTHORIZING PETITION FOR MEMBERSHIP IN THOMAS <br />JEFFERSON SOIL AND WATER CONSERVATION DISTRICT <br /> <br /> Mr. Tolbert said that the City was asked to join the Thomas Jefferson Soil and <br />Water Conservation District and staff think their services will be beneficial. <br /> <br /> On motion by Mr. Lynch, seconded by Ms. Hamilton, the resolution authorizing <br />the petition for membership in the Soil and Water Conservation District was approved by <br />the following vote. Ayes: Dr. Brown, Mr. Caravati, Ms. Hamilton, Mr. Lynch, Mr. <br />Schilling. Noes: None. <br /> <br />BE IT RESOLVED <br /> by the Council of the City of Charlottesville, Virginia that <br />the City Manager, or his designee, is hereby directed to submit on behalf of the City a <br />petition to the Virginia Soil and Water Conservation Board to add all of the territory <br />within the legal boundaries of the City of Charlottesville to the Thomas Jefferson Soil <br />and Water Conservation District (TJSWCD). <br /> <br />BE IT FURTHER RESOLVED <br /> that the fee associated with such membership in <br />TJSWCD ($1,000) shall be taken from already appropriated funds in the Council Reserve <br />Fund. <br /> <br /> <br />RESOLUTION <br />: SPECIAL USE PERMIT FOR HIGHER DENSITY RESIDENTIAL <br />TH <br />AT 218 9 STREET, S.W. AND 848-854 ESTES STREET <br /> <br /> Mr. Brian Haluska, Planner in Neighborhood Development Services, explained <br />that the Planning Commission voted to recommend denial of the special use permit <br />because they had reservations about the application and wanted the applicant to work <br />further with the neighborhood. He said no further submission was received from the <br />applicant. Mr. Haluska noted that the project could be done by right if it is mixed use. <br /> <br /> Responding to a question from Ms. Hamilton, Mr. Tolbert said that this area was <br />originally called the transition zone between commercial and residential, but the Planning <br />Commission recognized that this designation is not appropriate. Mr. Tolbert said that <br />there could be 43 units by right if mixed use. He said the concern is that there is no <br />definition about the amount of mixed use required, and that this density would be allowed <br />with only minor changes. <br /> <br /> Mr. Lynch noted that the 1995 Comprehensive Plan contemplated a connector <br />road in this location, but that was decided against in 1996. <br /> <br /> Mr. Lynch made a motion to deny the special use permit as he does not see <br />anything compelling about the proposal, and Mr. Schilling seconded the motion. <br /> <br /> Mr. Caravati said he will abstain from voting. He said he thinks we can do more <br />for the neighborhood if we do not deny the permit. He suggested that we work with the <br />property owners. <br /> <br /> Mr. Caravati offered a substitute motion to defer the special use permit, and Mr. <br />Schilling seconded the motion, but expressed concern that the applicants previously did <br />not respond to the request for information and he hopes that was just an oversight. <br /> <br /> Responding to a question from Dr. Brown, Mr. Tolbert said that if the matter is <br />deferred it can be brought back at any time, but if it is denied it cannot come back for 12 <br />months. He said by right development could occur at any time. <br /> <br /> Council agreed to consider the substitute motion to defer by the following vote. <br />Ayes: Dr. Brown, Mr. Caravati, Ms. Hamilton, Mr. Schilling. Noes: Mr. Lynch. <br /> <br /> Ms. Hamilton said she finds it difficult to make a determination about the special <br />use permit based on the information available. <br /> <br /> <br />
