109 <br />APPROPRIATION <br />d. : $90,848 – Fire Training Grant (carried over) <br /> <br />APPROPRIATION <br />e. : $6,751.45 – Sheriff’s Department Extraditions <br /> Reimbursement (carried over) <br /> <br />APPROPRIATION <br />f. : $3,527.24 – Sheriff’s Department Special Events <br /> Reimbursement (carried over) <br /> <br />APPROPRIATION <br />g. : $4,626.93 – VML Insurance Money Remittance <br /> (carried over) <br /> <br />APPROPRIATION <br />h. : $311.00 – Memorial Tree Contributions <br /> <br />RESOLUTION <br />i. : Renaming Moore Street to Nunley Street <br /> <br />BE IT RESOLVED <br /> by the Council of the City of Charlottesville, Virginia, that <br />the unimproved right of way currently designated as Moore Street, located between Paton <br />Street and Spring Street in the Fifeville neighborhood, shall hereinafter be officially <br />named Nunley Street, as recommended by staff and the City’s E-911 Coordinator. <br /> <br />RESOLUTION <br />: EXTENDING LEASE FOR NEWSSTAND ON DOWNTOWN <br />MALL <br /> <br /> Mr. Lynch asked why the existing kiosk could not be used for this purpose as he <br />has just found out that it is currently does not have a tenant. He said if this is not possible <br />then we should discuss the possibility of moving it off the mall and allowing a vendor in <br />its place. <br /> <br /> Mr. Jim Tolbert, Director of Neighborhood Development Services, said that the <br />RFP process for a new tenant for the kiosk has just been completed and a new lease will <br />be signed in the near future. He said using the kiosk as the newsstand was discussed, but <br />it was in the wrong location and it cannot be moved. He noted that the newsstand has <br />been approved by the Board of Architectural Review. He said that the kiosk tenant will <br />provide visitor information and fresh cut flowers. <br /> <br /> On motion by Mr. Schilling, seconded by Mr. Lynch, the Resolution Extending <br />the Lease for the Newsstand on the Downtown Mall was approved by the following vote. <br />Ayes: Dr. Brown, Mr. Caravati, Ms. Hamilton, Mr. Lynch, Mr. Schilling. Noes: None. <br /> <br />WHEREAS <br /> , by ordinance adopted June 20, 2005, City Council approved the <br />lease of approximately 300 square feet of City right-of-way on the Downtown Mall to <br />Steven Russell (the “Tenant”), the leased premises to be used exclusively as a newsstand; <br />and <br /> <br />WHEREAS <br /> , the said Lease Agreement expires June 5, 2006 and the Tenant <br />wishes to extend the lease until June 30, 2007; and <br /> <br />WHEREAS <br /> , Tenant also wishes to modify the terms of the Lease Agreement to <br />allow he sale of cigarettes and other tobacco products, packaged candy, and souvenir or <br />novelty items, in addition to newspaper and magazine publications, and the Director of <br />Neighborhood Services has no objection; now, therefore <br /> <br />BE IT RESOLVED <br /> by the Council of the City of Charlottesville, Virginia that <br />the Lease Agreement dated June 6, 2005, between the City and Steven Russell, for the <br />lease of City right-of-way on the Downtown Mall, is hereby extended until June 30, <br />2007, and Section (4) of the Lease Agreement is hereby amended to state as follows: <br /> <br />(4) USE: The leased Premises shall be used as exclusively as a newsstand, for <br />the purpose of offering newspapers, magazines, and periodicals for sale to the <br />general public. Tenant may, in his sole discretion, also offer for sale cigarettes <br />and other tobacco products, packaged candy, and souvenir or novelty items, in <br />addition to newspapers and periodicals. <br /> <br />
