5 <br />City will remove snow outside of the fence, but the Museum will be responsible for <br />maintenance inside the fence. He said the Museum will also be responsible for any <br />damage to the mall. <br /> <br /> The public hearing was opened. <br /> <br /> Ms. Colette Hall, 101 Robertson Lane, asked who will be liable if a child is hurt <br />on the carousel. She said she assumes space for emergency vehicles will remain. She <br />asked if the carousel will be up all year. <br /> <br /> Ms. Peppy Linden, Executive Director of the Virginia Discovery Museum, said <br />that bringing the carousel to the mall has been a four and a half year process. She said <br />the carousel will be free to the public and will be open the same hours as the Museum. <br />She said private funds have been raised for the fence, maintenance, security cameras, <br />signage, and liability insurance. She said the carousel was a gift from Fred Scott to the <br />Museum. <br /> <br /> As there were no further speakers, the public hearing was closed. <br /> <br /> Ms. Hamilton said she is happy to see closure on this project and made a motion <br />to approve the lease. <br /> <br /> Mr. Caravati seconded the motion. He said he has been involved in the project <br />for four years and thinks it will be a really nice addition to downtown. <br /> <br /> Mr. Lynch noted that the carousel will be set among the trees out of the fire lane. <br /> <br /> Mr. Brown clarified that the motion and second is for the revised resolution. <br /> <br /> The resolution approving the lease for the carousel for the Virginia Discovery <br />Museum was approved by the following vote. Aye: Mr. Caravati, Ms. Hamilton, Mr. <br />Lynch, Mr. Schilling. Noes: None. Absent: Dr. Brown. <br /> <br />WHEREAS, <br />the Virginia Discovery Museum seeks a lease of City-owned <br />property, on which to operate a stationary children’s carousel; and <br /> <br />WHEREAS, <br />the proposed lease is the subject of a public hearing conducted on <br />May 15, 2006, in accordance with the requirements of Virginia Code §15.2-1800(B); and <br /> <br />WHEREAS <br />, this Council desires to enter into a proposed lease under the terms <br />and conditions set forth following below; <br /> <br />NOW, THEREFORE, BE IT RESOLVED <br /> by the City Council of the City of <br />Charlottesville, Virginia, that the City Manager is hereby authorized to execute on behalf <br />of the City a written lease document, in a form approved by the City Attorney, containing <br />the following terms and conditions: <br /> <br />1. Leased Property: approximately 240 square feet of premises located in the 500 <br />block of the Downtown Mall, opposite the Virginia Discovery Museum; <br /> <br />2. Lease Term: a period commencing on June 15, 2006 and ending on June 30, <br />2011. <br /> <br />3. Rent: the amount of one dollar ($1.00) cash in hand paid; <br /> <br />4. Taxes and utilities: payable by Tenant, only if applicable. <br /> <br />5. Alterations: Tenant may attach a fence to the Mall, and may take reasonable <br />actions to secure the carousel, related signage, and a security camera to the <br />Property, but shall not make any other alterations to the Property without the <br />prior written approval of the City. <br /> <br /> <br />
