2 <br />recommends that Council uphold the BAR’s decision. She said if Council overturns the <br />decision, it should disband the BAR, Planning Commission and other boards and just <br />make all decisions itself. <br /> <br /> Mr. Timothy Snider, 239 E. Jefferson Street, echoed comments made by Ms. Hall, <br />and asked that Council uphold the BAR’s decision on the Main Street demolition. He <br />said the mall is successful in spite of large buildings, not because of them. He said the <br />proposed nine story development will diminish the mall. He said four or five stories <br />would be more appropriate. He said he opposes construction on that site of that scale. <br /> <br /> Mr. David Repass, 227 E. Jefferson Street, said that if Council does not uphold <br />the BAR’s decision regarding the Main Street demolition, a precedent will be established. <br />He said the mall is the best in the United States and has small town ambience within a <br />cosmopolitan city. He said a compromise was worked out years ago regarding what can <br />be demolished on this site and the owner must have known that when he purchased the <br />property. <br /> <br /> Mr. Kevin Munro, 318 Avon Street, said that private homes are being violated <br />because of the noise from the Pavilion. He said he understands it was not the intent to <br />impact lives, but it has. He asked Council to continue to discuss the issue. He said it is <br />better with the baffling, but is still an issue. <br /> <br /> Mr. Marshall Slayton, attorney representing Donnie McDaniel, said this Mr. <br />McDaniel owns three properties in Belmont that provide single room occupancy for <br />people who need it, and he is being forced to shut down by the City. He said single room <br />occupancy is a much cheaper alternative for residents. He said 20 individuals could be <br />put on the street, and that will cost a lot more than this housing. He said the City Code <br />requires that there be a living space shared by occupants, but he has been told this would <br />be more of a problem because this would cause friction among occupants. He said the <br />Thomas Jefferson Planning District Commission is studying how to have more of this <br />type of housing. He asked Council to look into the issue. He said the hearing is before <br />the judge on Thursday. <br /> <br /> Mr. Peter Kleeman, 407 Hedge Street, said Council has three appeals from the <br />BAR on its agenda. He aid Councilors do not have the expertise to understand the <br />nuances that the BAR members have. He expressed concern about the number of appeals <br />coming to Council. He recommended that the appropriate role of Council should be to <br />set targets of where historic preservation should be enhanced or pursued and to assure <br />that we have qualified and professional board members. He said Council should send the <br />appeals back to the BAR and encourage them to come up with a reasonable and equitable <br />decision. <br /> <br />th <br /> Mr. John Gaines, 217 9 Street, N.W. asked if a process has been developed for <br />thth <br />coming up with a name for the 9/10 Street Connector as a result of the petition he <br />presented at the last meeting. <br /> <br /> Dr. Brown said he thinks Mr. Gaines will see some action coming up in the near <br />future. <br /> <br /> Mr. Gaines said he is concerned about the development on Wertland Avenue and <br />said the neighborhood association has not had the discussion it deserves. He said he does <br />not support giving the houses to Habitat for Humanity. He said he hopes Council will <br />support the BAR’s decision. <br /> <br /> Mr. John Sweet, 1602 G Monticello Avenue, supported Mr. Munro’s comments <br />about the Pavilion noise. He said just because things are now tolerable does not mean <br />they are good enough. He said the idea of a wall supposedly got shot down by City staff. <br />He said the music should shut down by 10:00 p.m. on weeknights. <br /> <br /> Ms. Kimber Hawkey, 709 Belmont Avenue, said the noise and reverberation is <br />injurious to the quality of life. She said she feels an ending time of 9:00 p.m. would be <br /> <br />
