3 <br />Cherry Avenue Corridor <br /> <br /> Mr. Tolbert said that in 1998 a transition zone was created with the commercial <br />and residential areas. He said that some mistakes were probably made in areas that were <br />included (i.e. Grove Street and Estes Street areas) because they are not suitable for <br />commercial uses and have no access. He said he believes there is a need to look at this <br />and look at less intensives uses for those areas. <br /> <br /> Mr. Lynch said that the transition zone was well intentioned, but he feels it was a <br />failure. He said nothing has happened on this corridor. <br /> <br /> Mr. Tolbert said that we need to define what we want to see and mean by mixed <br />use. <br /> <br /> Mr. Lynch said that he thinks the parking allowed in also an issue. <br /> Responding to a question from Mr. Lucy, Mr. Craig Brown, City Attorney, said <br />that rezoning is a legal reduction in the intensity of the permitted use of property. He said <br />it is still a downzoning even if it does not reduce the value of the property, though it <br />likely would reduce the likelihood that it may be challenged. He said that downzonings <br />done in a comprehensive manner are generally defensible. <br /> <br /> Ms. Lewis said we need to decide what the appropriate percentages are in the mix <br />for mixed use. <br /> <br /> Mr. Tolbert said we need to also look at where boundaries should be. <br /> <br /> Mr. Lynch said that a road parallel to West Main Street has been discussed in the <br />past, but it is clear now that there will be no road. He said he feels a justification to <br />change the zoning would be to say transportation plans have changed. <br /> <br />Rose Hill Neighborhood <br /> <br /> Mr. Tolbert said this issue is similar to that in the Woolen Mills neighborhood <br />with heavy commercial and industrial zoning. He said the neighborhood is struggling to <br />stabilize and have asked that the City look at more appropriate transitioning back to <br />residential zoning. Mr. Tolbert said the same model could be used as will be done in the <br />Woolen Mills. He said the issue is how can be move the area toward residential. <br /> <br /> Mr. Farruggio said that commercial could be moved to the right of the <br />neighborhood and the left developed as housing. <br /> <br /> Mr. Craig Barton, Planning Commissioner, said there needs to be a buffer <br />between the commercial and residential areas. <br /> <br /> Dr. Brown asked if the actual use of property can be a justification for <br />downzoning, and Mr. Brown said that would be a factor in the City’s favor. <br /> <br />Fry’s Spring Neighborhood <br /> <br /> Mr. Tolbert said that the Fry’s Spring neighborhood feels that with the increased <br />development around the University some pressure has been taken off of their <br />neighborhood, but the remaining two-family zoning is at odds with their attempts to <br />stabilize, and they would like to prevent additional conversions to two-family housing. <br /> <br /> Dr. Brown said he understands the desire for single family, owner occupied <br />housing, but said there is a need for rental property in the City, and Stribling Avenue may <br />be an area suitable for affordable housing. <br /> <br /> Ms. Lewis suggested going back to the neighborhood and asking what part they <br />would like downzoned. She said there could be a compromise on the phasing. <br /> <br /> <br />
