Noes: None. <br /> <br />WHEREAS <br />, the University of Virginia Foundation (“Applicant”) has requested a special <br />use permit with respect to property identified on City Tax Map 10 as Parcels 60, 61, 63, 81.1, 82 <br />th <br />and 83 (located on the south side of West Main Street between 11 Street and Jefferson Park <br />Avenue), consisting of approximately 2.73 acres (collectively, hereafter the “Subject Property”) <br />to allow additional height above that permitted by City Code §34-637; and <br /> <br />WHEREAS, <br />the Subject Property is located within the West Main Street South Mixed <br />Use Corridor District (“WMS”) and is within the parking exempt area established pursuant to <br />§34-971(e) of the City Code; and <br /> <br />WHEREAS <br />, pursuant to §34-637 of the City Code, up to seven (7) stories of building <br />height may be allowed within the WMS zoning district when approved by special use permit; and <br /> <br />WHEREAS, the building(s) for which additional height is requested have been identified <br />by the Applicant as one(s) to be used for medical offices and an associated parking garage, and <br />within the WMS zoning district: i) medical offices are allowed by right, and (ii) parking garages <br />that are used ancillary to a by-right use, such as medical offices, are permitted by right; and <br /> <br /> <br />WHEREAS <br />, a joint public hearing on this application was held before the City Council <br />and Planning Commission on October 10, 2006, following notice to the public and to adjacent <br />property owners as required by law; and <br /> <br />WHEREAS <br />, on October 10, 2006, based on the information presented by Neighborhood <br />Development Services staff as well as by the Applicant, the Planning Commission recommended <br />that the application be approved; and <br /> <br />WHEREAS <br />, this City Council finds and determines that granting the Special Use Permit <br />would be consistent with City Code Chapter 34, Article VI, Division 6 and with the criteria <br />generally applicable to special use permits under Chapter 34, Article I, Division 8 of the City <br />Code; NOW, THEREFOR, <br /> <br />BE IT RESOLVED <br /> by the Charlottesville City Council that a special use permit is <br />hereby granted for an increase in building height from five (5) stories to seven (7) stories for the <br />medical office building and ancillary parking garage proposed by the Applicant to be established <br />on the Subject Property. <br /> <br />ORDINANCE <br />: TECHNOLOGY ZONE TAX INCENTIVE PROGRAM EXTENSION <br /> <br /> Mr. Aubrey Watts, Director of Economic Development and COO, said that <br />several months ago a proposal was brought to Council to extend the Technology Zone <br />Tax Incentive Program. He said questions were asked at that time about whether it is still <br />an effective tool. He said that Mr. Norris and Mr. Taliaferro met with representatives of <br />technology businesses and the Virginia Piedmont Technology Council. He said it was <br />determined that the program is most effective for the first three years, but after that it is <br />not much of an incentive, so the restriction of three years was added to the ordinance. <br /> <br /> Mr. Norris thanked Mr. Watts and representatives of the business community who <br />he said came up with good ideas for the program. <br /> <br /> Mr. Taliaferro also thanked the business representatives, and said the program is <br />another step to put emphasis on workforce development and open up opportunities for <br />citizens. <br /> <br /> Dr. Brown thanked Mr. Norris and Mr. Taliaferro for looking at the issue. <br /> <br /> On motion by Mr. Lynch, seconded by Mr. Norris, the ordinance entitled “AN <br />ORDINANCE TO AMEND AND REORDAIN CHAPTER 14 (LICENSES) SECTION <br />14-24 (TAX INCENTIVES FOR TECHNOLOGY BUSINESSES) OF THE CODE OF <br />THE CITY OF CHARLOTTESVILLE (1990), AS AMENDED, TO REAUTHORIZE <br />THE TECHNOLOGY ZONE TAX PROGRAM AND TO LIMIT THE NUMBER OF <br />YEARS IN WHICH A QUALIFIED TECHNOLOGY BUSINESS MAY <br /> <br />
