5 <br /> Mr. Norris asked why an LIP of 10 points is recommended rather than 15, and <br />Ms. Walden said that 15 points gives an additional two units per acre and this proposal <br />only needs 10 points. <br /> <br /> Mr. Norris said that if the applicant agrees to 15 points then he will support that. <br /> <br /> Mr. Lynch said that Ms. Hamilton raises a good point about the competing <br />interests, and whether you respect the historic house or the neighborhood, or say that as <br />an individually protected property the new building should not be supported. He said his <br />preference would be to send it back to the BAR and Planning Commission to resolve. <br /> <br /> Ms. Hamilton said she thinks the building should be subordinate to the historic <br />structure. <br /> <br /> Mr. Taliaferro agreed this is a difficult situation. He said he would personally like <br />to see the building closer to the street and more consistent with the neighborhood. <br /> <br /> Dr. Brown said he agrees with Ms. Hamilton, but he is not an expert and would <br />prefer to defer to the BAR which includes design experts. He suggested that the BAR be <br />made aware of Council’s discussion. He suggested that the special permit be approved <br />and that it be sent back to the BAR with Council and Planning Commission <br />recommendations. <br /> <br /> On motion by Mr. Lynch, seconded by Mr. Norris, the Resolution Approving the <br />Special Permit for Infill Development at 513 Dice Street, with the total LID worksheet <br />points increased to 15 and location of the building left to the BAR, was approved by the <br />following vote. Ayes: Dr. Brown, Mr. Lynch, Mr. Norris, Mr. Taliaferro. Noes: Ms. <br />Hamilton. <br /> <br />WHEREAS <br />, Jane Covington (“Applicant”) has requested a special use permit <br />with respect to property identified on City Tax Map 29 as Parcel 63.1 (513 Dice Street), <br />consisting of approximately 0.21 acres (“Subject Property”), to allow infill development <br />by subdivision of the existing lot into two (2) lots and construction of an additional single <br />family detached dwelling; and <br /> <br />WHEREAS <br />, an individually designated historic structure (Shackleford-Bannister <br />House) is located on the subject parcel, which is zoned “R-1S” (Residential – Small Lot); <br />and <br /> <br />WHEREAS <br />, the Subject Property is within a designated area for infill <br />development, pursuant to Sec. 34-166(c), and infill development is allowed by special <br />use permit, pursuant to City Code Sec. 34?165, within an R-1S zone; and <br /> <br />WHEREAS <br /> , a joint public hearing on this application was held before the City <br />Council and Planning Commission on May 8, 2007, following notice to the public and to <br />adjacent property owners as required by law; and <br /> <br />WHEREAS <br />, on May 8, 2007, based on the information presented by <br />Neighborhood Development Services staff, as well as by the Applicant and the Board of <br />Architectural Review, the Planning Commission recommended that the application be <br />approved, with conditions; and <br /> <br />WHEREAS <br />, this City Council finds and determines that granting the Special Use <br />Permit would be consistent with City Code §34-165, et seq. and the criteria generally <br />applicable to special use permits under Chapter 34 of the City Code; now, therefore, <br /> <br />BE IT RESOLVED <br /> by the Charlottesville City Council that a special use permit <br />is hereby granted to allow infill development of the Subject Property, with increased <br />density from 7.2 units per acre to 9.52 units per acre, by construction of an additional <br />single family residence on the Subject Property, subject to the following conditions: <br /> <br /> <br />
