7 <br />OTHER BUSINESS <br /> <br /> Mr. Norris asked for an update about the issue of the historic property in Woolen <br />Mills, and what if anything could Council be asked to do. <br /> <br /> Mr. Brown said that the City’s zoning administrator was asked if the property in <br />question is covered by the City’s historic zoning ordinance, and he ruled that it is not. He <br />said an adjoining property owner appealed this decision to the Board of Zoning Appeals <br />who upheld the ruling. He said the adjoining property owner has 30 days to appeal the <br />BZA decision. As far as Council’s role in the matter, Mr. Brown said that Council can <br />initiate rezoning of the property to include it in the ordinance. He cautioned Council that <br />the property owner has certain vested rights and noted that the site plan has already been <br />approved. <br /> <br /> Mr. Lynch asked what the policy is on subdivision of individually designated <br />historic property. He said we have shown tonight that it can be done, and the BZA’s <br />decision was consistent with that. <br /> <br /> Mr. Brown said individually designated property can be subdivided, but both <br />would remain subject to the historic ordinance. He said that only one of those lots was <br />covered by the ordinance in 2002. <br /> <br /> Mr. Norris said he is sympathetic to allegations of that nature. He asked if an <br />appeal to the Court would preclude Council from taking up the matter, and Mr. Brown <br />said no. <br /> <br /> Ms. Hamilton said that a number of neighborhoods have asserted that mistakes <br />have been made, including one in her neighborhood. She said that as a matter of simple <br />fairness if we seek out and pursue this one instance we should have a consistent policy of <br />intervening. She said she does not necessarily object to intervening, but when we know <br />there are others she does not think it is fair to single this one out. <br /> <br /> Dr. Brown noted that Council is long removed from the decision and the site plan <br />has been approved. <br /> <br /> Mr. Brown said that the BZA encouraged the property owner, who is a member of <br />the BAR, to work with the BAR. <br /> <br /> Mr. Norris asked if the project will come before Council, and Mr. Brown said not <br />if it is a by-right development. <br /> <br /> Mr. Taliaferro asked for an update regarding repairs on the downtown mall, and <br />Mr. O’Connell said that funding is included to replace the bricks, and staff will come <br />back with a plan, and said that community meetings will also be held. <br /> <br /> Mr. Norris expressed concern that there has been a business survey and survey of <br />th <br />drivers crossing the mall as part of the evaluation of the pilot vehicular crossing at 4 <br />Street, but there has been no survey to capture pedestrians’ opinions. He asked that this <br />be done before it is placed on the agenda. He thinks that would be valuable information <br />to have. <br /> <br /> Mr. Lynch agreed that makes sense. <br /> <br /> Councilors agreed that a pedestrian survey would be done within the general area <br />th <br />of the 4 Street mall crossing. <br /> <br /> Referring to the Emergency Medical Services oversight committee that Council <br />approved forming, he said we may be really looking at just involvement by the City and <br />issues within the City limits. He suggested that the City appoint a committee to look at <br />response times and any problems that currently exist, and determine what the City can do <br />to alleviate the problems, getting the County’s feedback in the process.
