6 <br />BE IT RESOLVED <br /> by the Charlottesville City Council that the Special Use <br />Permit for the Subject Property approved by this Council on June 4, 2007, is hereby <br />amended to allow reduction of the rear yard setback from 25 feet to 10 feet. FOR SOUTH LAWN PROJECT <br /> <br /> Mr. Craig Brown, City Attorney, explained that the University of Virginia has <br />requested that the City convey air rights over Jefferson Park Avenue for a pedestrian <br />walkway, convey an easement for the foundation for the walkway, and convey a <br />temporary construction easement for the project. He said questions have been raised <br />about the possibility of adequate clearance for a future street car. He said the minimum <br />clearance under the walkway will be 17.5 feet and the minimum clearance for a streetcar <br />is 16 feet, so there is adequate space. He noted that the conveyance of the air rights <br />requires a four fifths vote by Council. <br /> <br /> The public hearing was opened, but as there were no speakers, the public hearing <br />was closed. <br /> <br /> Mr. Lynch noted that the site plan for rezoning at the Fontaine Research Park <br />does not include a Southern Connector, and asked the University representative if that is <br />the case. <br /> <br /> Ms. Mary Hughes, representing the University of Virginia, said she is not able to <br />answer the question. <br /> <br />
