13 <br /> <br /> Mr. Taliaferro said if that is solving the problem he would not favor changing the <br />park hours. <br /> <br /> Dr. Brown said he would like to see if other things are working first, and favored <br />adopting a wait and see attitude. <br /> <br /> Mr. Svetz said that at the very least he would like to have Jackson Park included <br />in the ordinance. <br /> <br /> Mr. Brown suggested that the ordinance be deferred to the next meeting as there <br />are some housekeeping items in the ordinance that need to be addressed. <br /> <br /> Dr. Brown asked that the Police respond to keeping the park hours from 11:00 <br />p.m. to 6:00 a.m. <br /> <br /> On motion by Mr. Hamilton, seconded by Mr. Lynch, the ordinance regarding <br />park hours was deferred by the following vote. Ayes: Dr. Brown, Ms. Hamilton, Mr. <br />Lynch, Mr. Norris, Mr. Taliaferro. Noes: None. <br /> <br />PUBLIC <br /> <br /> There were no matters by the public. <br /> <br />OTHER BUSINESS <br /> <br /> Mr. Norris said that the Art in Place Whale Tail sculpture is very popular and he <br />understands that negotiations have been underway for the City to lease or purchase it. He <br />said staff would like guidance from Council. <br /> <br /> Mr. Taliaferro said he understands that the durability of the Whale Tail is an <br />issue. <br /> <br /> Mr. Svetz said originally the artist was asking $100,000 for the Whale Tail, but <br />said it is listed on the Art in Place website as being valued at $30,000. He said in the past <br />Art in Place art has been purchased for between $5,000 and $7,000. He said durability of <br />the structure is an issue. He said the last offer by the City was to lease the Whale Tail for <br />3 years at $5,000 a year, or one year for $5,000. <br /> <br /> Mr. Lynch said we should discuss this in the context of how we deal with art <br />generally. He said if the City purchases art it ought to be a public process. He suggested <br />having something like an annual citizens choice award. <br /> <br /> Mr. O’Connell said that Mr. Svetz is working with the Parks and Recreation <br />Advisory Committee to come up with a process. <br /> <br /> Mr. Svetz said that Arts has an award process which could be taken to the Parks <br />and Recreation Advisory Committee. <br /> <br /> Mr. Lynch said he would like to see it opened up for anybody to vote. <br /> Dr. Brown said he is not all that keen on having a standing process. He said he <br />likes people getting excited about something. He said one flaw is that Council is not an <br />artistic body, but he is not sure the Parks and Recreation Advisory Committee fits the bill <br />either. He said he would like to have a mechanism in place for when it is needed. <br /> <br /> Responding to a question from Mr. Norris, Mr. Svetz said that the Percent for Art <br />program is no longer funded, but there is a balance of $200,000. <br /> <br /> Mr. Norris said he would agree to lease the Whale Tail with the artist maintaining <br />responsibility for maintenance, with it structured as a lease/purchase agreement for five <br />years at $3,000 per year, and after five years if it is still in one piece the City would <br />assume ownership. <br /> <br />
