9 <br /> <br /> Dr. Brown said he has heard that new restaurants are frustrated about not getting <br />café space or small ones wanting to expand their cafes, and he said he would like to see if <br />this works as we move forward. He said if the vendors are still displaced in the second <br />quarter he would be open to waiving fees for that time period as well. <br /> <br /> On motion by Mr. Huja, seconded by Dr. Brown, Council approved the café and <br />vendor amendments as recommended by Mr. Tolbert by the following vote. Ayes: Dr. <br />Brown, Ms. Edwards, Mr. Huja, Mr. Norris, Mr. Taliaferro. Noes: None. <br /> <br /> WHEREAS, <br /> the planned restoration of the Downtown Mall will temporarily <br />prevent downtown restaurants from operating sidewalk cafes during a portion of the mall <br />construction; and <br /> <br />WHEREAS, <br /> vendors will not be allowed to set up tables on the Downtown Mall <br />during at least a portion of the construction period; and <br /> <br />WHEREAS, <br /> City Council desires to mitigate the negative impact on businesses <br />and vendors during the reconstruction of the Downtown Mall during the spring and <br />summer of 2009; now, therefore, <br /> <br />BE IT RESOLVED <br /> by the City Council of the City of Charlottesville that: <br /> <br /> <br />1.The fee for café permits, imposed under City Code Section 28-211, for <br />Downtown Mall restaurants will be waived for the period of March 1, <br />2009 through November 20, 2009. This waiver shall remain in effect even <br />if a restaurant is permitted by the City to operate a sidewalk café on the <br />Downtown Mall prior to November 20, 2009. <br /> <br /> <br />2.Vendor stand space fees, imposed under City Code Section 28-116, for <br />Downtown Mall street vendors shall be waived for the period of January <br />1, 2009 through March 31, 2009. During the construction period street <br />vendors will be allowed to set up tables only at the east end of the <br />Downtown Mall in front of City Hall, at such locations assigned by the <br />Neighborhood Development Services staff. <br /> <br /> <br />3.Sidewalk café operations and vendor stands will be authorized to resume <br />as soon as conditions on their assigned street block allow for the safe <br />operation of such cafes and vendor stands, as determined by the City’s <br />Construction Project Manager. <br /> <br />REPORT <br />: MOBILIZING FOR ACTION THROUGH PLANNING AND <br />PARTNERSHIPS (MAPP) PLANNING REPORT <br /> <br /> Dr. Lilian Peake, Director of the Thomas Jefferson Health District, reviewed the <br />final report outlining the findings of the assessments and priority health issues for the <br /> <br />
