5 <br /> <br />BE IT FURTHER RESOLVED, that a copy of this resolution be spread upon the <br />minutes of the May 4, 2009 meeting and sent to Buckingham Branch Railroad. <br /> <br />RESOLUTION <br />g. : Extending Time for Planning Commission Study of <br /> Parking Exemption <br /> <br />WHEREAS <br />, by Resolution adopted February 17, 2009, City Council directed the <br />Planning Commission to initiate a study of proposed amendments to Chapter 34 (Zoning) <br />of the Charlottesville City Code, 1990, as amended, to eliminate the parking exempt <br />zones; enact requirements for on-site parking, off-site parking, and payment into a fund <br />to build a new public parking garage and/or to create a park & ride system; and to include <br />incentives for developers to encourage carpooling, car shuttling, biking, or use of mass <br />transit; and <br /> <br /> WHEREAS <br />, Sec. 34-42(c) of the City Code, as amended, requires the Planning <br />Commission to report findings and a recommendation to City Council within 100 days of <br />initiation of proposed amendments, i.e. no later than May 28, 2009; and <br /> <br />WHEREAS <br /> , on April 14, 2009, the Planning Commission held a joint public <br />hearing on the proposed amendments, and after discussion on the issues involved, <br />decided they needed additional information and further discussion before a <br />recommendation to Council could be made; and <br /> <br />WHEREAS <br /> , the Planning Commission has formally requested an additional 150 <br />days to study the issues and report their findings and recommendations to Council; now, <br />therefore <br /> <br />BE IT RESOLVED <br /> that the Planning Commission is hereby directed to report <br />their findings and recommendations on the above-described proposed amendments, as <br />directed by Resolution approved February 17, 2009, no later than October 26, 2009. <br /> <br />RESOLUTION <br />h. : Approving Special Use Permit for Club 216 <br /> <br />WHEREAS <br />, the Piedmont Triangle Society, lessee of commercial building space <br />on property at 609 East Market Street, owned by Townsquare Associates, has requested a <br />special use permit with respect to the property identified on City Tax Map 53 as Parcel <br />100, consisting of approximately 37,350 square feet (“Subject Property”), to allow <br />operation of a private club; <br /> <br />WHEREAS <br />, Townsquare Associates supports the request for a special use permit <br />by the Piedmont Triangle Society to use the leased space as a private club; and <br /> <br /> WHEREAS <br />, the Subject Property is zoned Downtown Corridor Mixed Use <br />District, and, pursuant to §34-796 of the City Code, such modifications for use of the <br />property are allowed by Special Use Permit; and <br /> <br />WHEREAS <br />, following a joint public hearing before this Council and the <br />Planning Commission, duly advertised and held on April 14, 2009, this Council finds that <br />such use is allowed under City Code Section 34-796, and will conform to the criteria <br />applicable to special permits generally under Chapter 34 of the City Code; now, therefore <br /> <br />BE IT RESOLVED <br /> by the Council of the City of Charlottesville, Virginia that a <br />special use permit is hereby approved and granted to the Piedmont Triangle Society to <br />allow operation of private club at 609 East Market Street. Approval of this special use <br />permit is conditioned upon the following: <br /> <br /> <br />1.No source of sound emanating from the club during the hours between <br />11:00 p.m. and 6:00 a.m. shall exceed seventy-five (75) dB(A), when <br />measured at or outside the property boundary; and <br /> <br />2.The club shall provide security in the form of a uniformed police <br />officer in the courtyard of the building for all events. <br /> <br />
