6 ORDINANCE i. : “AN ORDINANCE AMENDING AND REORDAINING SECTION 34-286 OF THE CODE OF THE CITY OF CHARLOTTESVILLE, 1990, AS AMENDED, RELATING TO APPEALS OF BAR DECISIONS TO CITY nd COUNCIL” (2reading) ORDINANCE j. : “AN ORDINANCE AMENDING AND REORDAINING SECTIONS 28-211, 28-212 AND 28-214 OF ARTICLE VI OF CHAPTER 28 (STREETS AND SIDEWALKS) RELATING TO SIDEWALK CAFÉ nd OPERATIONS” 2 reading) PUBLIC HEARING/ORDINANCE : CONVEYING RIGHT OF WAY ON NORTH AVENUE Ms. Francesca Fornari, Assistant City Attorney, explained that the request is to sell 366 square feet of City property to the adjacent property owners. She said the land is essentially their yard now, and the title insurance company raised a question about the ownership. She said the sales price is $1,625. The public hearing was opened. Mr. William Marshall, attorney representing the owners, said that this is a technical title problem. As there were no further speakers, the public hearing was closed. On motion by Mr. Huja, seconded by Dr. Brown, the ordinance entitled “AN ORDINANCE AUTHORIZING THE CONVEYANCE OF CITY-OWNED PROPERTY (ASHBY PLACE AND NORTH AVENUE RIGHT OF WAY) TO JOSEPH B. MURRARY AND SARAH S. McIVOR” was offered and carried over to the next meeting for consideration. PUBLIC HEARING/RESOLUTION : COMMUNITY DEVELOPMENT BLOCK GRANT ACTION PLAN FOR FY 2010 Ms. Melissa Celii, Grants Coordinator, said that an additional $12,000 was received in CDBG funds, and $16,000 in HOME Funds. She said the CDBG Task Force wanted the funds to go to AHIP. She said the Action Plan updates the City’s goals and objectives. Ms. Celii explained that Council could have to amend the plan if we get stimulus money. Responding to a question from Ms. Edwards, Ms. Celii said the plan was posted on the Thomas Jefferson Planning District Commission and City websites and was advertised in the Daily Progress. Ms. Edwards said she would like more information on the actual number of people who found a place to live. She said she would also like to see how CDBG funding can be tied into Council priorities, i.e., workforce development. She said the stimulus funds may be an opportunity to look at this. She said she would like to see if there is a real way to move people out of poverty with CDBG funds. Mr. Huja asked how many houses AHIP plans to rehabilitate with these funds, and Ms. Celii said five to six. The public hearing was opened, but as there were no speakers, the public hearing was closed. On motion by Mr. Huja, seconded by Dr. Brown, the Community Development Block Grant Action Plan for FY 2010 was approved by the following vote. Ayes: Dr. Brown, Ms. Edwards, Mr. Huja, Mr. Taliaferro. Noes: None. Absent: Mr. Norris.
