7 <br />TOTAL $485,000 <br /> <br />ORDINANCE <br />: REZONING 101, 102, 103, 104,105, 106, 124-A, 126, 128-A, 129, 130- <br />A, 131, 132, 133, 134, 135 LONGWOOD DRIVE FROM R-2 TO PUD <br /> <br /> Mr. Brian Haluska, Planner in Neighborhood Development Services, said that a <br />joint public hearing was held on the rezoning in January, 2009. He said the proposal is to <br />demolish 18 units, renovate 16 units, and construct 43 townhouses. He said the Planning <br />Commission recommended denial by a four to two vote. He said an amended proffer <br />statement has been submitted. He explained that Council cannot vote on the new proffer <br />without holding a new public hearing, either jointly with the Planning Commission, or <br />separately by itself. <br /> <br /> Dr. Brown asked what happens if the proffer is not abided by, and Mr. Haluska <br />said it would be considered a zoning violation. <br /> <br /> Mr. Craig Brown, City Attorney, said that the zoning administrator would take the <br />matter to court. <br /> <br /> Dr. Brown asked if criteria are written down with regard to qualified Section 8 <br />clients. He said he thinks the proffer has been improved, and he is favorably inclined to <br />move forward. He said he would like to be assured that there is not too much discretion <br />in the amended proffer. <br /> <br /> Mr. Huja suggested that Council hold a public hearing on the amended proffer. <br />He said this is an opportunity to improve the neighborhood. <br /> <br /> Ms. Edwards asked if there has been any community engagement since the last <br />proffer, and Mr. Haluska said he is not aware of any. <br /> <br /> Mr. Norris strongly encouraged the applicant to talk with the neighborhood. <br /> <br /> Ms. Edwards said this rezoning provides an opportunity to create a community, <br />noting the school and church close by. She asked how we can set the tone that there <br />should be meaningful and substantive community engagement, and better communication <br />about what the changes are going to be. <br /> <br /> Dr. Brown made a motion for Council to hold a public hearing on the final proffer <br />statement. Mr. Huja seconded the motion, and it was approved by the following vote. <br />Ayes: Dr. Brown, Ms. Edwards, Mr. Huja, Mr. Norris, Mr. Taliaferro. Noes: None. <br /> <br />OTHER BUSINESS <br /> <br /> Mr. Huja said he would like to investigate legislation that would change the <br />current deadline for the Council elections so that the nominations are not required so far <br />in advance of the election. <br /> <br /> Mr. Brown said this would require a change in State legislation. He said <br />paperwork is now due in early June for the November elections, but when the election <br />was held in May, the paperwork was due in early March. He suggested this be included <br />in the legislative packet. <br /> <br /> Dr. Brown suggested that we work with other localities as well as VML and <br />Virginia First Cities to garner broader support. <br /> <br />RESOLUTION <br />: ENDORSING 2035 UNJAM PLAN <br /> <br /> Mr. Norris said that one project that was in the initial Unjam Plan, the grade <br />separated intersection at Hydraulic, was taken out, but the Planning Commission <br />recommends that it be put back in. <br /> <br /> <br />
