6 <br />WHEREAS <br />, K Holdings LLC supports the request for a special use permit by <br />First Street Ventures LLC to use the leased space as a dance hall; and <br /> <br /> WHEREAS <br />, the Subject Property is zoned Downtown Corridor Mixed Use <br />District, and, pursuant to §34-796 of the City Code, such modifications for use of the <br />property are allowed by Special Use Permit; and <br /> <br />WHEREAS <br />, following a joint public hearing before this Council and the <br />Planning Commission, duly advertised and held on July 14, 2009, this Council finds that <br />such use is allowed under City Code Section 34-796, and will conform to the criteria <br />applicable to special permits generally under Chapter 34 of the City Code; now, therefore <br /> <br />BE IT RESOLVED <br /> by the Council of the City of Charlottesville, Virginia that a <br />special use permit is hereby approved and granted to allow operation of a dance hall at <br />101 and 103 South First Street. Approval of this special use permit is conditioned upon <br />the following: <br /> <br />There shall be no audible noise, detectable vibration or odor <br />beyond the confines of the building in which the dance hall is <br />located, including transmittal through vertical or horizontal party <br />walls, between the hours of 2:00 a.m. and 8:00 a.m. <br /> <br />RESOLUTION <br />l. : Region Ten Community Services Board Contract with Va. <br /> Dept. of Mental Health, Mental Retardation & Substance <br /> Abuse Services <br /> <br /> BE IT RESOLVED <br /> by the Council of the City of Charlottesville, Virginia that this <br />Council hereby approves the Fiscal Year 2010 Performance Contract between Region <br />Ten and the Virginia Department of Mental Health, Mental Retardation & Substance <br />Abuse Services (VDMHMRSAS), a copy of which is available in the City Manager’s <br />Office. <br /> <br /> RESOLUTION <br />m.: Supporting Grant Application for State Funding for Multi- <br /> Use Trail Boardwalk along 250 Bypass <br /> <br />WHEREAS <br /> , the Department of Conservation and Recreation has a Recreational <br />Trails program to encourage development of trails in harmony with the natural <br />environment; and <br /> <br />WHEREAS <br /> , the City of Charlottesville intends to provide a network of trail <br />facilities, especially along and across major streets and near schools and recreation <br />facilities; and <br /> <br />WHEREAS <br /> , the City of Charlottesville’s Comprehensive Plan and Bicycle and <br />Pedestrian Master Plan both recommend construction of this critical link in the trail <br />network; and <br /> <br />WHEREAS <br /> , designs for the trail have identified the need to construct an elevated <br />boardwalk portion to protect trees and water quality; and <br /> <br />WHEREAS <br /> , there is already funding for the overall trail project to cover the <br />required $18,000 in local match money; <br /> <br /> NOW, THEREFORE BE IT RESOLVED <br /> by the Council for the City of <br />Charlottesville that the City of Charlottesville endorses an application to the Virginia <br />Department of Conservation and Recreation for Recreational Trail funding to enhance the <br />sustainability of the planned Route 250 Bypass / McIntire Park multi-use trail boardwalk. <br /> <br /> BE IT FURTHER RESOLVED <br /> that the City of Charlottesville accepts the <br />responsibility of maintenance of the proposed infrastructure in perpetuity. <br /> <br /> <br /> <br />
