7 <br /> <br />ORDINANCE <br />n. : AN ORDINANCE AUTHORIZING THE <br /> ABANDONMENT OF A NATURAL GAS EASEMENT GRANTED TO THE CITY <br /> BY NEXT GENERATION, LLC <br /> <br />ORDINANCE <br />o. : AN ORDINANCE AMENDING AND REORDAINING <br /> SECTIONS 34-1, AND 34-971 OF ARTICLE IX, OF CHAPTER 34 (ZONING) OF <br /> THE CODE OF THE CITY OF CHARLOTTESVILLE, 1990, AS AMENDED, <br /> RELATING TO PARKING EXEMPT ZONES <br /> <br />ORDINANCE <br />p. : AN ORDINANCE AMENDING AND REORDAINING <br /> SECTION 15-133 OF ARTICLE V OF CHAPTER 15 (MOTOR VEHICLES) <br /> RELATING TO PARKING SPACES RESERVED FOR PERSONS WITH <br /> DISABILITIES <br /> <br />PUBLIC HEARING/ORDINANCE <br />: CONVEYANCE OF PORTION OF <br />JEFFERSON PARK AVENUE RIGHT-OF-WAY <br /> <br /> Mr. Jim Tolbert, Director of Neighborhood Development Services, said the <br />conveyance of this property will allow for construction of intersection improvements to <br />enhance pedestrian safety. He said the City will pay the lesser amount of either $75,000 <br />or 50% of the project. He recommended that payment for the right-of-way be waived. <br /> <br /> Responding to a question from Mr. Huja, Mr. Tolbert said that once the <br />improvements are made the property will be public. <br /> <br /> The public hearing was opened, but as there were no speakers, the public hearing <br />was closed. <br /> <br /> On motion by Dr. Brown, seconded by Mr. Huja, the ordinance entitled “AN <br />ORDINANCE AUTHORIZING THE CONVEYANCE OF CITY-OWNED PROPERTY <br />(JEFFERSON PARK AVENUE RIGHT OF WAY AT THE EMMET STREET <br />INTERSECTION) TO TENTH AND MAIN, LLC” was offered and carried over to the <br />next meeting for consideration. <br /> <br />PUBLIC HEARING/ORDINANCE <br />: CONVEYANCE OF LAND BETWEEN ELM <br />STREET AND CHERRY AVENUE <br /> <br /> Mr. Brown said a request has been made to purchase land locked City property. <br />He said staff does not object to the sale as the only purpose of the property is a <br />stormwater easement which would remain. He said the sale could allow larger lots or <br />larger units, but no additional units. <br /> <br /> The public hearing was opened. <br /> <br /> Ms. Carolyn Powell said she would like to buy back the piece of property that was <br />sold by her family. <br /> <br /> Mr. Ervin Gibson said he has maintained the property and he would like to get the <br />property back that belonged to his father. <br /> <br /> Mr. Francis Barnett, owner of 716 Cherry Avenue, said it is incorrect that Mrs. <br />Chisholm has maintained the property, as his family has maintained it. <br /> <br /> As there were no further speakers, the public hearing was closed. <br /> <br /> Mr. Brown said he is not personally aware of who has maintained the property, <br />but the City has not. He said that the property could be sold to more than one property <br />owner. He said he can pursue the matter with the other property owners. <br /> <br /> Mr. Huja said he would agree to sell the property to others if they want to pay the <br />fair market value. <br /> <br />
