Edwards, seconded by Ms. Daugherty, the resolution declaring a <br />local emergency due to weather conditions was unanimously approved by Council. <br /> <br />WHEREAS, the City Council of the City of Charlottesville does hereby find that: <br /> <br /> 1. Due to the recent blizzard conditions resulting in extraordinarily hea~ snowfalls and <br />impassable streets for this community, the City of Charlottesville is facing the threat of a <br />disaster; and <br /> <br /> 2. Said threat is in sufficient severity and magnitude to warrant coordinated local <br />government action to prevent or alleviate the damage, loss, hardship, and suffering threatened <br />or caused by said snowfalls and street conditions; and <br /> <br /> 3 Because of this situation, a condition of extreme peril of life and property <br />necessitates the proclamation of the existence of an emergency. <br /> <br /> NOW, THEREFORE, IT IS HEREBY PROCLAIMED that an emergency now <br />exists throughout the City of Charlottesville; and <br /> <br /> IT IS FURTHER PROCLAIMED AND ORDERED that, effective 1200 hours, <br />Sunday, January 7, 1996, the powers, functions, and duties of the Director of Emergency <br />Services (the City Manager) and the emergency service organizations of the City of <br />Charlottesville shall be those prescribed by state law and the ordinances, resolutions, and <br />approved plans of the City of Charlottesville in order to mitigate the effects of said <br /> <br />emergency. <br /> <br /> Mr. Toscano said he has also been asked to acknowledge the transit workers for their <br />work during the snow emergency. <br /> <br />PUBLIC <br /> <br />There were not matters by the public. <br /> <br />OTHER BUSINESS <br /> <br /> At the request of Ms. Slaughter, Mr. O'Connell explained that the governor's budget <br />proposes changes in the Business, Professional, and Occupation tax that would reduce <br />revenue to the city by between $436,000 and $600,000. <br /> <br /> Ms. Daugherty announced that the Solid Waste Task Force will hold a public meeting <br />on Wednesday and the upcoming business skills series that will be shown on public access. <br /> <br /> On motion by Rev. Edwards, seconded by Ms. Slaughter, Council voted, with Mr. <br />Vandever voting no, to meet in executive session for the purpose of discussing appointments <br />to boards and commissions, as authorized by Section 2.1-344(A)(1); for the purpose of <br />considering the acquisition or use of real property for public purpose, or the disposition of <br />publicly held property, as authorized by Section 2.1-344(A)(3) of the Virginia Code, and <br />more specifically described as the CSX property; and for the purpose of consultation with <br />legal counsel and briefings by staff' members, consultants or attorneys, pertaining to probable <br />litigation, or other specific legal matters requiring the provision of legal advice by counsel, as <br />authorized by Section 2.1-344(A)(7) of the Virginia Code. The substance of the matters to <br />be discussed can reasonably be identified as follows: changes in the form of local government <br />structure, and related alternatives. An executive session on this subject is also authorized by <br />Section 15. t-945.7(D) of the Virginia Code. <br /> <br /> Council reconvened in open session and, on motion by Rev.
