124 <br /> <br /> Mr. Cox said he is concerned about encroachment into the neighborhood, adding that <br />he feels the parking lot proposal is beyond the zone of respect. <br /> <br /> Responding to a question from Mr. CoX, Ms, Slaughter said that the proposed parking <br />lot would be for the use of employees of West Main Street who now park in public spaces, <br />thereby freeing up those spaces for the public. <br /> <br /> Ms. R/chards said that the proposal needs to be looked at from both perspectives: the <br />need to provide more parking and the need to protect the neighborhood. <br /> <br />The ordinance was deferred until staff.meets with members of the neighborhood. <br /> <br />ORDINANCE: REZONING LOTS 4 AND 5 ON WEST SIDE OF 5TH ST~ET FROM <br />R-3 TO B-3 <br /> <br /> Mr. Huja explained that the Planning Commission, by a 4 to 3 vote, recommended <br />denial of the rezoning to B-3 since the proposed and potential uses would be incompatible <br />with the neighborhood and the adjacent historic property. Mr. Huja said that staffhad <br />recommended approval of B-2 zoning, <br /> <br /> Ms. Daugherty said she has concerns about uses allowed in B-2 zones, but would like <br />to consider B-1 zoning. <br /> <br /> Mr. Huja said that the proposed use, an office for a painting contractor, would not fit <br />into B-1 zoning. <br /> <br /> Responding to a question from Mr. Cox, Mr. Huja said that the Planning Commission <br />changed the land use designation in 1995 from residential to commercial for the area because <br />it is a transitional area. <br /> <br /> Mr. Cox said he feels this is another instance of commercial encroachment into a <br />neighborhood. Mr. Cox said such uses are usually unattractive. Mr. Cox questioned how the <br />City is going to protect the neighborhood from the pressures of West Main Street. <br /> <br /> Ms. Daugherty noted that the property is used commercially now, and said she does not <br />feel it is suitable for residential use. <br /> <br /> Mr. Herman Key, a Fifeville resident, said the neighbors are completed opposed to the <br />rezoning and possible future uses. <br /> <br /> Responding to a question from Mr. Toscano, Nh'. Huja said the use would not be <br />allowed in B-1 because of the storage of paint and equipment on the property and the overall <br />magnitude of the business. An appeal to the Board of Zoning Appeals could be made to <br />allow the business in the B-1 zoning. <br /> <br /> Responding to a question from Mr. Toscano about the legal rUles pertaining to <br />following the Comprehensive Plan, Mr. Gouldman said that while it is not automatic that the <br />zoning follows the Comprehensive Plan, if Council decides not to rezone to the current land <br />use designation, there need to be circumstances that justify doing so. <br /> <br /> Mr. Cox asked why the land use does not match the zoning, and Mr. Huja explained <br />that the land use plan is a general guide of where the City wants to be, while the zoning <br />reflects the current use. <br /> <br /> Mr. Cox said he did not know how the extent to which the Fifeville neighborhood had <br />been involved in the development of the Comprehensive Plan. <br /> <br /> Mr. Huja said that a public hearing on the Comprehensive Plan was held at Buford <br />School for the benefit of the Fifeville neighborhood, and Mr: Toscano noted that the City <br />then went back into the neighborhood for more feedback after the public hearing. <br /> <br /> <br />
