123 <br /> <br />approximately 407 feet of frontage on 5th Street, SW, and containing approximately 170,273 <br />square feet of land or 3.9 acres; <br /> <br /> WHEREAS, following a joint public hearing before this Council and the Planning <br />Commission, duty advertised and held on June 11, 1996, this Council finds that such use will <br />conform to the criteria applicable to special permits generally under Chapter 34 of the City <br />Code; now, therefore <br /> <br /> BE IT RESOLVED by the Council of the City of Charlottesville, Virginia that a <br />special use permit is hereby granted to BMW Partnership to allow relocation of the Pet Motel <br />animal shelter from its existing location on 5th Street, SW, and the addition of an animal <br />hospital/veterinarian's office, to an adjoining parcel approximately 200 feet southwest. <br />Approval of the special use permit is conditioned upon the following: <br /> <br /> (1) Administrative approval of the final site plan with all necessary data shown on the <br />final plan, including drainage data, specific building height, tree canopy area and signs. <br /> <br /> (2) Additional landscape to include junipers along the frontage down to the toe of the <br />slope and a minimum of 30 trees along the Moore's Creek terraces as called for in the original <br />special permit for that work, and any other work called for in the soil erosion plan. All <br />improvements to the slope at Moore's Creek and landscaping shall be completed prior to the <br />issuance of any occupancy permits. <br /> <br /> (3) Completion of the specific improvements to address the issues of sanitation, sound, <br />odor, and waste management, including but not limited to: <br /> <br />a. That drainage from interior pens go into the sanitary sewer system. <br />b. That the building area where animals are housed be enclosed with walls and <br />window construction having a sound transmission coefficient of at least 50 <br />STC. <br />c. Electronic air filtration system to eliminate all odor. <br />d. Calcium Carbonate scavenger system on all anesthetic machines. <br />e. All OSHA designated medical waste materials stored in hospital in OSHA <br /> designated sharp containers and picked up by an appropriate disposal <br /> company. <br />f. Heavy duty freezer to store all frozen carcasses until pickup for cremation, burial, <br /> or until other disposition has been decided upon by owner. <br />g. Evidence of extensive effort to recycle non-regulated waste. <br />h. Absolute hygiene to be instituted, utilizing surgical grade antiseptics used in <br /> similar institutions. <br /> <br />ORDINANCE: SALE OF PROPERTY ON ELSOM STREET (2nd reading) <br /> <br /> Ms. Slaughter explained that the sale of property on Elsom Street will be subject to a <br />public rezoning process and restrictive covenant that requires that the property be used as a <br />parking lot. <br /> <br /> Mr. Huja said that the property in question is one of the locations identified for off- <br />street parking on West Main Street. A private developer has proposed to purchase the lot <br />and relocate the small playground located on the property. The City has received a number~ <br />of complaints about people on the property creating a nuisance to the neighborhood. Mr. <br />Huja said that the church and neighbors have been notified of the rezoning public hearing. <br /> <br /> Ms. Alicia Lugo, a resident of Brown Street, asked Council not to sell the property <br />until the neighbors have an opportunity to hear about the proposal, including what the plans <br />are, who is buying it, what kind of buffer will there be, what will it took like, and what will <br />the impact be on the neighborhood. Ms. Lugo said that everyone who lives in the area, not <br />only those with adjacent property, should be notified. Ms. Lugo asked that action be <br />postponed until staff can meet with neighbors. <br /> <br /> <br />
