114 <br /> <br />As there were no further speakers, the public hearing was dosed. <br /> <br /> Ms. Slaughter stated that since the BAR is addressing the issue of aesthetics, Council <br />should focus on the fee issue. Ms. Slaughter asked about the feasibility of charging a <br />reduced daily or short-term vending fee and Mr. Gouldman recommended that he discuss the <br />matter with the Commissioner of Revenue. <br /> <br /> Responding to a question from Mr. Toscano, Mr. Gouldman stated that the vending fee <br />is not one of the regulations that is waived when a special event is declared by Council. <br /> <br /> Ms. Daugherty stated that Council might want to authorize a 3-month vending permit <br />for people who want to test a vending business, and recommended that the issue be deferred <br />to allow time to see if such a permit would be difficult to administer. Ms. Daugherty stated <br />that she is unclear about what Council is trying to achieve, and she would like more input <br />from the public on what they would like to see on the mall. Ms. Daugherty stated that she <br />would prefer to encourage more vendors who sell homemade crafts rather than manufactured <br />goods that compete with existing businesses. <br /> <br /> Ms Slaughter stated that she did not want to get into regulating homemade versus <br />other goods and agreed with the suggestion made to charge the fee based on the space used <br />by the vendors. <br /> <br /> Mr. Toscano stated that he is concerned that permanent businesses have overhead such <br />as rent which allows vendors who do not have such expenses to undercut their prices. <br /> <br /> Ms. Slaughter stated that she feels everyone who uses the mall should contribute to its <br />upkeep, but leveling the playing field is not part of her rationale for increasing fees. Ms. <br />Slaughter stated that she is interested in determing what is a fair price for use of the mall. <br /> <br /> Mr~ Vandever stated that leveling the playing field is not one of his objectives in <br />considering the issue, but rather he feels the fee should be based on the actual use of public <br />space. <br /> <br /> Mr. Toscano stated that he would be interested in getting an idea of the square footage <br />used by vendors. <br /> <br /> Ms. Slaughter made a motion to approve the ordinance, increasing the fee to $75 per <br />year, or $25 per quarter. Mr. Vandever seconded the motion. <br /> <br /> Mr. Gouldman stated that he would discuss the issue of offering a monthly or quarterly <br />permit with the Commissioner of Revenue. <br /> <br /> The ordinance entitled "AN ORDINANCE AMENDING AND REORDAINING <br />SECTION 14-49 OF CHAPTER 14 OF THE CHARLOTTESVILLE CITY CODE, 1990, <br />AS AMENDED, INCREASING THE BUSINESS LICENSE TAX FOR PEDDLERS AND <br />ITINERANT MERCHANTS" was carried over to the next meeting for consideration. <br /> <br /> Ms. Daugherty stated that the City Market Manager had recommended that the vending <br />size allowed be increased to 8 feet by 10 feet in order to accommodate tents used by City <br />Market participants. <br /> <br /> It was agreed that the Board of Architectural Review would be asked to make <br />suggestions about the size limitation and location of vendors as well as the design guidelines. <br /> <br /> Mr. James Woodfolk recommended that vendors be given all rules and regulations at <br />the time they are issued a license. <br /> <br />Mr. Larry Engel urged Council to enforce vending regulations. <br /> <br /> <br />
