127 <br /> <br /> On motion by Mr. Vandever, seconded by Rev. Edwards, the mayor was unanimously <br />authorized to sign the Charlottesville-Albemarle Convention and Tourism Bureau Contract. <br /> <br />ORDINANCE: CLOSING AN ALLEY BETVqEEN MONTICELLO ROAD AND <br />CLYDE STREET <br /> <br /> On motion by, seconded by, the ordinance entitled "AN ORDINANCE CLOSING, <br />VACATING AND DISCONTINUING AN ALLEY BETWEEN CLYDE STREET AND <br />MONTICELLO ROAD" was offered and carded over to the next meeting for consideration. <br /> Mr. Huja stated thatithe Planning Commission recommended that the alley be dosed <br />since no public benefit would be realized by maintaining the alley as a City right-of-way, <br />conditioned upon the owner agreeing to pay fair market price for the property. <br /> <br /> Mr. Clyde Gouldman, City Attorney, explained that while the street closing policy <br />includes charging rent for ialley and street closings, payment has only been required by <br />Council in one or two instances. <br /> <br /> Mr. Vandever stated that he would have trouble justifying charging the owner for the <br />property in this case, doe~ not see any public benefit in retaining the property, and feels it <br />would be beneficial to return the property to the tax rolls. <br /> <br /> Rev. Edwards stated that he only favors charging for property in situations where the <br />owner 5nancially benefits ifrom such closing. <br /> <br /> On motion by Rev. Edwards, seconded by Ms~ Daugherty, the ordinance entitled <br />"AN ORDINANCE CLO SING, VACATING AND DISCONTINUING AN ALLEY <br />BETWEEN CLYDE STREET AND MONTICELLO ROAD," without the requirement that <br />the owner pay for the property, was offered and carried over to the next meeting for <br />consideration. <br /> <br />ORDINANCE: CHARGING RENT ($1 PER SQUARE FOOT) FOR SIDEWALK CAFES <br />(2nd reading) <br /> <br /> On motion by Rev. <br />unanimously amended to <br />notify cafe owners of the <br /> <br /> The ordinance entit <br />SECTIONS 28-212 THll <br /> <br />Edwards, seconded by Ms. Daugherty, the ordinance was <br />change the effective date to May 1 to allow the necessary time to <br />rent. <br /> <br />.ed "AN ORDINANCE AMENDING AND REORDA1NING <br />OUGH 28-215 OF THE CHARLOTTESYqLLE CITY CODE, <br /> <br />1990, AS AMENDED, I~LATED TO IMPOSITION OF RENT FOR SIDEWALK CAFE <br />SPACE AND MI]~~ AMOUNT O,F, LIABILITY INSURANCE REQUIRED FOR <br />OPERATION OF SIDEWALK CAFES, as amended, which was offered at the January 17th <br />meeting, was approved b3 the following vote. Ayes: Ms. Daugherty, Rev. Edwards, Ms. <br />Slaughter, Mr. Toscano, Mr. Vandever. <br /> <br />PUBLIC <br /> <br /> Mr. Reid Oeschlin, 708 Nalle Street and a member of"Town Watch," stated that Town <br />Watch supports the Planning Commission recommendation to form a citizens group to make <br />recommendations about new roads. Mr. Oeschlin stated that he is concerned with the design <br />of the 9th/10th Street realignment as it cuts off neighborhood access, and with the proposed <br />parallel road which would cut along one edge of Fifeville. <br /> <br /> Mr. Toscano said the Council has not received a report from the Planning Commission, <br />but stated that there has been concern about the proposed parallel road for some time. <br /> <br /> Mr. Huja stated that the Virginia Department of Transportation is in the process of <br />acquiring the right-of-wa~y for the 9th/10th Street realignment and construction is due to <br />begin in 1996. Mr. Huja added that a neighborhood public heating had been held on the <br /> <br /> <br />
