213 could base a decision regarding the rates to be charged for the basic cable service tier and associated equipment; and WHEREAS, on March 7, 1995 the city sent a letter to Grantee requesting additional information on which to base its decision regarding Grantee's Rate Regul~.tion Forms; and WHEREAS, pursuant to 47 C.F.R.. Section 76.933(b), the City's 120 day time period for review of Ade[phia's Rate Regulation Forms ex~pired on Apill 17, 1995; and- WHEREAS, the City in order to accomplish its review in a timely manner, scheduled for its regular meeting date of Aprit 17, 1995 ~ufficient time for the purpose of reviewing Grantee's Rate Regulation Forms and related rate regulation inform~tioh; and WHEREAS, the City conducted a meeting open to the public on April 17, 1995 to ensure that all interested parties had ample opportunity to present information to the City; and WHEREAS, on April 17,1 995 the City passed and adopted a resolution which required Grantee to keen an aCcurate account of alt amounts received by reason of the rates at issue and on whose behaif such amounts were paid; and WHEREAS, the April 17,1 995 resolution also reserved, pursuant to 47 C.F.R. Section 76.933(C), the City's fight to subsequently issue a writteh deciSion disapproving any portion of Grantee's proposed rates; and WHEREAS, on April 21, 1995, four (4) days after the expiration of the city's 120 day review period, Grantee submitted to the City a new FCC Form 1220 seeking to jt~sti~ basi~ service tier rates utilizing a cost of ser'vSce anaiysis; and WHEREAS, pursuant to 47 C.F.R.. Section 76.933, the city provided Grantee with written notice that the time period for review of Grantee's FCC Fo~'m i220 would be extended for an additional 150 days; and WHEREAS, as a result of the City's initial review of Grantee's FCC Form I220 the City has obtained sufficient information on which to base its final decision regarding Grantee's Rate Regulation Forms and, in particular, the rates to be charged by Grantee with respect to the basic cable service tier; and WHEREAS, in particular the City has reviewed in detail Grantee's FCC Form i20 dated April 18, 1995, which was included as part of Grantee's April 21, 1995 Form 1220 submission, wherein Grantee provides accurat-e financial intbrma~ion regarding basic service tier rates resulting in a maximum permitted rate tbr the basic service tier of $6.61; and WHEREAS, the City has reviewed the accuracy of the information contained within Grantee's April i8, i995 FCC Form i200, which was included as part of Grantee's April 21, 1995 Form 1220 submission, and has found that the Form has been accurately compi~ted and contains vaiid information regarding the basic cable service tier rates; and WHEREAS, on this date the city has conducted a meeting open to the public to ensure that ail interested parties have had ample opportunity to present information t~) the City regarding this issue; and WHEREAS, based upon ali information available to the City, the CiW has determined to make the below listed Orders for Action. NOW, THEREFORE, in a regular meeting of the City Council of the City_ of Charlottesville, Virginia dated August 7, 1995 the following is resolved:
