214 <br /> <br />ORDERS FOR ACTION <br /> <br />The City hereby enters the following orders: <br /> <br />1. The City hereby adopts and makes a part of this Resolution <br /> all documents referenced above. <br /> <br />2. On April 17, 1995 the ciW_ adopted_ a Resolution which served <br /> as an 'accountin~ order" l~ursuant to 47 C.F.R.. Section 76.933(c). <br /> <br />The applicable time period for refunds shall comply with <br />47 C.F.R.. Section 36.942(c')(2), which provides that the refund <br />period shall run from the date of the accounting order to the date <br />a l~rosDective reduction issued, then back in time from the date <br />o~ the 'accounting order to the effective date of the FCCs rules; <br />however, the total refund period shall not exceed one year from <br />the date of the accounting order. <br /> <br />Pursuant to applicable FCC regulations, for the time period <br />beainning May 15, 1994 to present, the City hereby determines <br />t.h~t the basic cable service tier rate identified by Grantee in its <br />April i8,1 995 FCC Form 1200, which was included as part of <br />Grantee's April 21, i995 Form 1220 submission, is reasonable <br />and is in coml~liance with applicable federal law- and FCC <br />regulations a~d therefore Grantee shall be permitted to charge <br />not more than $6.61 tbr the basic service tier, exclusive of any <br />fi'anchise fees. <br /> <br />Grantee shall undertake any and ali necessary steps in accordance <br />with all applicable FCC regulations, to refund to all of Grantee's <br />subscribers residing within the City that portion of the amounts <br />raid for basic cable service tbr the period May 15, i994 to <br />bresent which exceed the maximum permitted rate of $6.6i <br />together with any franchise fees assessed thereon plus :interest to <br />the date of the refund. <br /> <br />Grantee shall properly determine the overcharges to basic service <br />tier subscribers for ti~e stated periods, and shall comply with ali <br />applicable FCC regulations to file a report with the City, stating <br />the cumulative refund amount so determined (including franchise <br />fees and interest), describing the calculation thereof, and <br />describing Grantee!s plan to implement the refund within the time <br />periods prescribed by applicable FCC regulations. <br /> <br />in accordance with FCC regulations, Grantee shall, within 30 days <br />of the date of this Resolution, reduce its basic service tier rate to <br />the maximum permitted rate of $6.6'1 (plus franchise feel. <br /> <br />This Resolution is based solely on the representations of Grantee <br />and on the documents incorporated herein by reference. Should <br />intbrmation come to the City's attention that these representations <br />were materially inaccurate the City specifically reserves the right <br />take appropriate action.
