250 <br /> <br />Mr. Toscano opened the floor for public comment, but no one came forward. <br /> <br /> Mr. Vandever said he believes the Accounting Order is the best option given the <br />circumstances. <br /> <br /> On motion by Ms. Daugherty, seconded by Rev. Edwards, Council unanimously <br />approved the Accounting Order resolution. <br /> <br /> WHEREAS, the City of Charlottesville, Virginia ("City") is the Grantor of a Cable <br />Communications Franchise Ordinance ("Ordinance") executed on or about June 15, 1992 by <br />and between the City and Multi-Channel T.V. Cable Company d/b/a Adelphia Cable <br />Communications (hereinafter "Grantee" or "Adelphia"); and <br /> <br /> WHEREAS, in accordance with applicable provisions of the Cable Consumer <br />Protection and Competition Act of 1992 (hereinafter the "Cable Act") and rules adopted by <br />the Federal Communications Commission ("FCC"), the City has undertaken all appropriate <br />procedural steps to regulate the basic cable service tier and associated equipment pursuant to <br />47 C.F.R. Part 76, Subpart N Sections 76.900-76-987; and <br /> <br /> WHEREAS, on April 21, 1995, Adelphia submitted to the City FCC Form 1220 <br />seeking to justify basic service tier rates utilizing a cost of service analysis; and <br /> <br /> WHEREAS, pursuant m 47 C.F.R. Section 76.933, the City provided Grantee with <br />written notice that the time period for review of Grantee's FCC Form 1220 would be <br />extended for an additional 150 days; and <br /> <br /> WHEREAS, the City is continuing to review the rates proposed by Grantee within <br />Grantee's FCC Form 1220; and <br /> <br /> WHEREAS, on this date the City has conducted a meeting open to the public to <br />ensure that all interested parties have had ample opportunity to present infbrmation to the <br />City regarding this issue; and <br /> <br /> WHEREAS, based upon all information available to the City the City has detemfined <br />to make the below list Orders for Action. <br /> <br /> NOW, THEREFORE, in regular meeting of the city council of the City of <br />Charlottesville, Virginia, on October 2, 1995, the following is resolved: <br /> <br />ORDERS FOR ACTION <br /> <br />1. The City hereby adopts and makes a part of this Resolution all <br /> documents referenced above. <br /> <br />Pursufint to FCC regulations at 47 C.F.K Section 76.933(c)3 the City <br />reserves its, ,right to hereafter issue a written decision disapp[¢¥i ~,t~y <br />por~l¢~,of ~t~]phia's proposed rates as identified in its FCC Form t~,~20 <br />receiv~,~9 [he City on April 21, 1995. <br /> <br /> 3: The ¢~ ~,e.~eby directs Adelptfia to keep an accurate accoun[ of all <br /> amou~ ¥~e}eived by reason of the rates in issue and on whose~e'half <br /> such amounts were paid. <br /> <br />P ~I~LIC <br /> <br />There were no matters by the public. <br /> <br /> <br />
