256 <br /> <br /> WHEREAS, ATO Fraternity House Corporation has requested a special use permit to <br />use the house at 125 Chancellor Street as a frate~ty house; this property being further <br />identified as Parcel 137 on City Real Property Tax Map 8, having 74 feet of frontage on <br />Chancellor Street and containing approximately 10,800 square feet Of land or .25 acres; <br /> <br /> WHEREAS, following a joint public hearing before this Council and the Planning <br />Commission, duly advertised and held on September 12, 1995, this Council finds that such <br />use will conform to the criteria applicable to special permits generally under Chapter 34 of <br />the City Code; now, therefore <br /> <br /> BE IT RESOLVED by the Council of the City of Charlottesville, Virginia that a <br />special use permit is hereby granted to ATO Fraternity House Corporation to use the house <br />at 125 Chancellor Street as a fraternity hOuse. <br /> <br />The approval of this special use permit is conditioned upon the following: <br /> <br />1. Administrative approval .of a site plan which includes plans for adequate <br /> on-site parking for no less than 7 :automobiles. <br /> <br />2. Access to the building for persons with a disability in accord with ADA <br /> standards. <br /> <br />The alley to the rear of the subject property shall be paved and maintained <br />by Applicant with signage provided by Applicant prohibiting parking in <br />the alley - all of which is intended to allow adequate access to the on-site <br />parldng. <br /> <br />The subject property must be kept and maintained by Applicant in strict <br />compliance with (a) City Code 17-30 which prohibits accumulations of <br />refuse, trash, broken glass, paper, etc,; (b) the 'Virginia Statewide Fire <br />Fire Prevention Code; and (c) the Virginia Uniform Statewide Building <br />Code, including but not limited to Property Maintenance (PM) Sections <br />304.5 (related to weatherproofing and surface coating of walls), 304:6 <br />(related to roofs and drainage), and 304.11 and 304. t 1.I (related to <br />window and door frames and glazing). Such maintenance compliance <br />shall include annual inspections by City Code officials pursuant to the <br />"Contract" between the Applicant and the University of Virginia. <br /> <br />Any exterior changes to the building and site which are or will be subject <br />to public view from any public street or public right-of-way must be <br />reviewed by the Board of Architectural Review before these changes are <br />effected. <br /> <br />ORDINANCE: HYPERION TELECO~CATIONS FRANCHISE <br /> <br /> Mr. Gouldman explained that the proposed franchise is a non-exclusive five-year <br />franchise to a competitive access provider between customers and long distance providers, <br />primarily commercial customers. In lieu of a franchise fee, the City will obtain, at Hyperion's <br />expense, four single mode dark fiber strands between City Hall and the Joint Security <br />Complex. <br /> <br /> Responding to a question from Ms. Slaughter, Mr. O!Connelt explained that the <br />connection will provide a link in the future between the Joint Security Complex and the <br />courts. <br /> <br /> Ms. Daugherty questioned if the fiber will be put underground where feasible, and Mr. <br />Gouldman said that Hyperion plans to lease existing fiber optic lines that are already in place, <br />but the ordinance gives the Director of Public Works discretion to require undergrounding of <br />new lines where feasible. <br /> <br /> <br />
