Vandever. <br /> <br /> On motion by Ms. Slaughter, seconded by Mr. Vandever, the resolution approving the <br />sale of the CSX property to Mr. Kuttner was approved by the following vote. Ayes: Ms. <br />Slaughter, Mr. Toscano, Mr. Vandever. Noes: Ms. Daugherty and Rev. Edwards. <br /> <br /> WHEREAS, on November 14, 1995, the Charlottesville Industrial Development <br />Authority (CIDA) approved the sale of Parcel A-2-4.1 of the CSX property, along with a <br />portion of the Water Street Extension right-of-way, to Oliver C. Kuttner for adaptive re-use <br />of the coal tower and for other development, subject to certain design controls and reviews; <br />now, therefore, <br /> <br /> BE IT RESOLVED by the Council of the City of Charlottesville, Virginia that the <br />Option Agreement and Land Purchase and Development Agreement, in substantially the same <br />form as attached hereto, between the CIDA and Oliver C. Kuttner, dated October 2, 1995, is <br />hereby approved. <br /> <br />ORDINANCE: CREATING UNDERGROUqqD UTILITY CORRIDOR (9TH/10 <br />STREET PROJECT (2nd reading) <br /> <br /> The ordinance entitled "AN ORDINANCE ESTABLISHING AN UNDERGROUND <br />UTILITY CORRIDOR FROM 9TH STREET TO 10TH STREET IN ACCORDANCE <br />WITH THE VIRGINIA DEPARTMENT OF TRANSPORTATION POLICY ON <br />PLACING UTILITY FACILITIES UNDERGROUND," which was offered at the November <br />20th meeting, was approved by the following vote. Ayes: Ms. Daugherty, Rex,. Edwards, <br />Ms. Slaughter, Mr. Toscano, Mr. Vandever. Noes: None. <br /> <br /> WHEREAS, by ordinance duly adopted, the City council for the City of <br />Charlottesville, Virginia has established an Underground Utility Corridor from the <br />intersection of 9th Street and Cherry Avenue north to 0.07 mile north of Main Street on 10th <br />Street, including Lane Road Extended from 1 lth Street and Lee Street to the 9th-10th Street <br />Connector, pursuant to the Virginia Department of Transportation policy on Planing Utility <br />Facilities Underground; and <br /> <br /> WHEREAS, the City desires that all utility relocations for the 9th-10th Street <br />Connector Road project located in such Underground Utility Corridor be placed underground <br />in accordance with the aforesaid policy; and <br /> <br /> WHEREAS, pursuant to this policy it is necessary that the City specifically request the <br />Virginia Department of Transportation (VDOT) to have all such utility relocations placed <br />underground; and <br /> <br /> WHEREAS, the city is required to provide certain other assurances in regard to the <br />undergrounding of future utility facilities; now, therefore, <br /> <br />BE IT RESOLVED by the Council of the City of Charlottesville, Virginia: <br /> <br /> Section 1. That the Virginia Department of Transportation is hereby <br />requested to have all utility relocations for the 9th-10th Street Connector Road <br />project placed underground in accordance with the Virginia Department of <br />Transportation Policy on Placing Utility Facilities Underground. <br /> <br /> Section 2. That future utility facilities for any proposed improvement, <br />including street lighting, shall not be permitted to be placed overhead within <br />any section of a street or roadway where the utility facilities were placed <br />underground in accordance with this policy. <br /> <br /> <br />
