public hearing, duly advertised as required by Section <br />30-19.04 of the Virginia Code, held on April 5, 1993; and <br /> <br /> WHEREAS, this Council has examined and considered the <br />provisions of Section 30-19.04(B) of the Virginia Code and <br />finds that MACAA: <br /> <br /> i) Is exempt from taxation pursuant to Section 501(c) <br />of the Internal Revenue Code of 1954; <br /> <br /> 2) Holds no current license from the Alcoholic Beverage <br />Control Board~ <br /> <br /> 3} Pays no compensation to any officer or director in <br />excess of reasonable allowance for services rendered; <br /> <br /> 4) Does not distribute any part of its~net earnings to <br />any individual and that all funds come from contributions, <br />local, state and federal grants~ <br /> <br />5) Provides services for the common good of the public; <br /> <br /> 6) Does not carry on any substantial political <br />activity; <br /> <br /> 7) Has no rule, regulation, policy or practice <br />discriminating on the basis of religious conviction, race, <br />color, sex, or national origin; and <br /> <br />8) Provides services to low income community residents. <br /> <br /> NOW, ~THEREFORE~ BE IT.RESOLVED by the Council of the <br />City of Charlottesville, Virginia, that the Council hereby <br />endorses, supports and approves the adoption of an amendment <br />to Title 58.1 of the Code of Virginia exempting certain real <br />property currently owned by the McIntire Land Trust located <br />at 1027 Park Street~ provided that such tax exemption shall <br />be limited and apply only to the following described real <br />property; <br /> <br />Ail that certain tract or parcel of land with the <br />improvements thereon, fronting on the north side of <br />U. S. 250, a by-pass road, a short diStance west of <br />the intersection of said Road with Park Street, <br />containing 7.445 acres, more or less, together with <br />that certain lot fronting 70 feet on the west side <br />of Park Street and running back between parallel <br />lines to the 7.445 acre parcel described above, <br />being the same property conveyed to McIntire Land <br />Trust by The Covenant School, Inc. by deed of <br />exchange dated August 25, 1989, of record in the <br />Charlottesville Circuit Court Clerk's Office in Deed <br />Book 533, page 235; <br /> <br />and said Council recommends that this exemption, if granted, <br />be placed in the "charitable,, classification. <br /> <br /> BE IT FURTHER RESOLVED that said exemption from real <br />property tax for the real property at 1027 Park Street shall <br />apply only during the time that MACAA owns said property and <br />uses it exclusively for MACAA's charitable purposes, and that <br />no personal property and no other real property owned by <br />M~CAA shall be exempt from taxation pursuant to this <br />resolution. <br /> <br /> BE IT FURTHER RESOLVED that the Clerk of the Council is <br />directed to convey certified copies of this resolution to the <br />members of the General Assembly representing the City. <br /> <br />RESOLUTION: APPROVING ISSUANCE OF $1 MILLION REVENUE BONDS FOR <br />MACAA FOR PURCHASE OF YMCA PROPERTY ON PARK STREET <br /> <br />On motion by Rev.
