<br /> Ms. Daugherty stated that she would like to avoid costly
<br />legal fees.
<br />
<br /> Mr. Gouldman stated that he understood that if Council
<br />does not become certified prior to the end of the rate freeze
<br />on November 15th then the benchmark rate of $13.20 could
<br />become the basic tier rate as opposed to the current rate of
<br />$8.70. :'~-

<br /> It was agreed that Council would meet on= October 8th at
<br />10:00 a.m. to further discuss the issue via conference call
<br />with the City's cable consultant.
<br />
<br /> Mr. Vandever requested that Council be advised about how
<br />real the possibility was for Adelphia to make a case for
<br />higher rates and whether Council's taking action to regulate
<br />would drive up the rates.
<br />
<br /> Rev. Edwards asked how Adelphia could justify raising
<br />their rates to the benchmark of $13.20 when they have said
<br />they have no plans to raise rates.
<br />
<br /> Ms. Daugherty requested that staff prepare an estimate
<br />of staff time that would be required as a result of the City
<br />regulating rates.
<br />
<br />ORDINANCE: SUBDIVISION AND ZONING AMENDMENTS
<br />
<br /> Mr. Satyendra Huja, Director of Community Development,
<br />reviewed the subdivision and zoning amendments which included
<br />conforming to state laws; standardization of fees; height
<br />reductions; parking exempt zones; and additions to local
<br />historic designations.
<br />
<br /> Ms. Slaughter questioned the rationale for requiring
<br />less recreation area for low income housing development and
<br />Mr. Huja explained that the Planning Commission felt cost was
<br />an important consideration.~ ~
<br />
<br /> Ms. Slaughter stated that she felt there was a need for
<br />recreation space in low income housing and stated that she
<br />would prefer that the requirement remain at 8 units.
<br />
<br /> Ms. Daugherty stated that she felt room and boarding
<br />houses and tourist homes should be allowed in B-5 districts
<br />by right and car washes and private recreational facilities
<br />should be allowed with a special permit.
<br />
<br /> Mr. Toscano recommended that radio, teleVision,
<br />telephone, and telegraph stations be allowed by right and
<br />expressed concern about certain properties included on the
<br />list of historic properties.
<br />
<br /> Ms. Slaughter stated that she felt the Board of
<br />Architectural Review would use appropriate judgment when
<br />dealing with changes to property included in the historic
<br />designation.
