Edwards, seconded by Ms. Daugherty, <br />the ordinance entitled "AN ORDINANCE AMENDING AND REENACTING <br />THE DISTRICT MAP INCORPORATED IN SECTION 34-15 OF THE~ZONING <br />ORDINANCE OF THE CODE OF THE CITY OF CHARLOTTESVILLE, 1990, <br />AS AMENDED, BY THE REZONING OF CERTAIN PROPERTY LOCATED AT <br />1013 LINDEN AVENUE" was offered and carried over to the next <br />meeting for consideration. <br /> <br />ORDINANCE: AUTHORIZING CONVEYANCE OF PROPERTY ON 8TH ST., N.W. <br /> <br /> Mr. O'Connell explained that the ordinance would convey <br />a small portion of City property at fair market value where a <br />private building encroaches on City property. <br /> <br /> On motion by Mr. Toscano, seconded by Rev. Edwards, the <br />ordinance entitled "AN ORDINANCE TO AUTHORIZE THE CONVEYANCE <br />OF PROPERTY LOCATED ON EIGHTH STREET, N.W. TO THE CAPITAL <br />LAND TRUST" was offered and carried over to the next meeting <br />for consideration. <br /> <br />RESOLUTION: CABLE TV BASIC TIER RATE REGULATION <br />ORDINANCE: CABLE TV BASIC TIER RATE REGULATION <br />RESOLUTION: CABLE TV EXPANDED TIER RATE REGULATION <br /> <br /> Mr. Gouldman explained that in 1992 Congress <br />re-regulated cable rates and directed the Federal <br />Communications Commission to implement new regulations. <br />The FCC imposed a rate freeze effective September, 1992 <br />which expire November 15, 1993, gave localities the option to <br />regulate the basic tier of cable service, if the localities <br />become certified to do so, and provided localities or cable <br />customers a vehicle to request the FCC to regulate rates for <br />expanded tiers of service~ Mr. Gouldman stated that the <br />City's cable consultants have advised the City to become <br />certified to regulate rates for the basic tier of~service and <br />to take the steps necessary to trigger FCC regUlation of <br />expanded service tier rates. Mr. Gouldman stated that <br />representatives of Adelphia Cable oppose the City regulating <br />rates and have indicated that doing so will force Adelphia to <br />seek an early rate increase. Adelphia has proposed an <br />a!ternative~proposal to amend the franchise agreement to <br />require 60 days notice for any rate increases whiCh would <br />allow time .for the City to become certified if it chose to do <br />so. <br /> <br /> Mr. John'Glicksman, attorney for Adelphia Cable, stated <br />that the question is whether the City should get into rate <br />regulation at the present time and continued that Adelphia <br />would like to build a relationship with the City based on <br />trust and he felt having the City regulate rates wOuld create <br />an adversarial relationship which could involve litigation in <br />the future. Mr. Glicksman stated that Adelphia is willing to <br />amend the franchise agreement as explained by Mr. Gouldman. <br />Mr. Glicksman stated that Adelphia Cable's response to <br />regulation would be to react defensiVely. <br /> <br /> Responding to questions from Ms. Slaughter, Mr. <br />Gouldman explained that the regulation language is silent on <br />the length of time a city becomes certified to regulate and <br />the only way for the City to take action to request that the <br />FCC regulate rates for expanded tiers of service is to file a <br />complaint form. <br /> <br /> Rev. Edwards stated that he felt Adelphia Cable's <br />attitude about the City regulating rates amounted to a threat <br />to raise rates. <br /> <br /> Mr. Delmas Hanley, Manager of Adelphia Cable, stated <br />that no rate increases are planned in the next year. <br /> <br /> Ms. Slaughter stated that she wanted to preserve the <br />City's right to regulate but wanted to avoid taking action <br />that might accelerate a rate increase.
