175 <br /> <br /> Responding to a question from Ms. Daugherty, Mr. Clyde <br />Gouldman, City Attorney, explained that competition would <br />continue to be pursued by requiring that a minimum of three <br />telephone calls be placed to vendors in lieu of formal <br />bidding. <br /> <br /> On motion by Ms. Daugherty, seconded by Rev. Edwards, the <br />ordinance entitled "AN ORDINANCE AMENDING AND REORDAINING <br />SECTIONS 22-52 AND 22-53 OF THE CHARLOTTESVILLE CITY CODE, <br />1990, AS AMENDED, RELATING TO PROCUREMENT" was offered and <br />carried over to the next meeting for consideration. <br /> <br />PRESENTATION: BOYS AND GIRLS CLUB <br /> <br /> Mr. Lucky Harris, Executive Director, and Mr. Bill <br />Nitchman, Vice President of the Board for the Boys and Girls <br />Club, gave an update to Council on the activities and <br />membership of the Boys and Girls Club. <br /> <br /> Mr. Harris stated that the Club opened in November of <br />1992 and currently has 540 members. Mr. Harris thanked the <br />City for use of the Smith Center for the Club's activities, <br />Mr. Harris stated that Club members pay $5 in dues and <br />approximately 65% of the members are City residents. <br /> <br /> Mr. Nitchman stated that the Club is funded privately and <br />through grants and the Parents Club has been taking an active <br />role. <br /> <br /> Ms. Daugherty requested that Mr. Harris provide her with <br />a list of Boys and Girls Club board members. <br /> <br />APPROPRIATION: YEAR END ADJUSTMENTS <br /> <br /> On motion by Rev. Edwards, seconded by Ms. Daugherty, the <br />Year End Adjustment appropriation was offered and carried over <br />to the next meeting for consideration. <br /> <br />RESOLUTION: CABLE TV RATE REGULATION EXTENSION <br /> <br /> Mr. Gouldman explained that the City received Adelphia <br />Cable's rate reporting form which was then sent to the City's <br />consultants for a desk audit. The consultants felt that the <br />information reported was incomplete and recommended that the <br />City adopt the resolution which would give an additional 90 <br />days to analyze the information and request more information <br />from Adelphia. <br /> <br /> Mr'. Toscano stated that it was his understanding that the <br />additional information will provide information on other cable <br />rates and will help the City decide if rates other than the <br />basic rates are reasonable or merit other action. <br /> <br /> On motion by Rev. Edwards, seconded by Ms. Slaughter the <br />resolution requesting a Cable TV rate regulation extension was <br />unanimously approved. <br /> <br /> WHEREAS, Multi-Channel TV Cable Company, d/b/a Adelphia <br />Cable Communication ("Adelphia") has on December 13, 1993, <br />filed its Form 393 with the City of Charlottesville (the <br />"City"), as part of the basic service tier rate regulation <br />process) and <br /> <br /> WHEREAS, the City is unable to determine from such <br />filling whether the rates in issue are within the Federal <br />Communication Commission ("FCC") standards; and <br /> <br /> WHEREAS, additional time beyond the initial 30 day review <br />period is needed by the City to obtain and analyze additional <br />information from Adelphia; and <br /> <br /> WHEREAS, FCC regulations allow the City to seek an <br />extension of 90 additional days by the City's own "order," <br /> <br /> <br />
