That the minimum of 15% enrollment for infant care in the day care be maintained. 3. That times of operation continue to be limited to weekdays from 6:00 a.m. to 6:00 p.m. provided that no outside play activities occur before 8:00 a.m. After-school events shall only be allowed inside and must be completed by 9:30 p.m. 4. That the number of children occupying the day care facilities not exceed 125 and the number of pupils attending classes in the school not exceed 150. 5. That the proposed 2 and 3 year old tot lot be relocated to a part of the site as shown on the site plan dated Jan. 18, 1994. 6. Installation of an elevator between buildings A and B to provide access for disabled individuals. RESOLUTION: SETTLEMENT OF CLAIM On motion by Ms. Daugherty, seconded by Rev. Edwards, the resolution approving a settlement and compromise was unanimously approved by Council. BE IT RESOLVED by the Council of the City of Charlottesville, Virginia, as follows: 1. Everyone involved in behalf of the City and the family of Jermaine Cummings was and is saddened by his death on July 20, 1993, following an accident at a private pool party held in the Smith Recreation Center. 2. With this incident in mind, the City has continued its practice of periodically evaluating the City's pool policies, procedures, equipment, and training efforts in order to provide the safest pool environment as is reasonably possible. 3.
