235 <br /> <br /> Responding to a question from Ms. Daugherty, Rev. <br />Templeton st~ated that the school could learn to live with <br />restricting the number of students in the playground to 70, <br />but felt that lowering the school enrollment to 125 would hurt <br />the school. <br /> <br /> Mr. Toscano asked how~the.school would addressed concerns <br />and complaints if raised by the neighborhood and Rev. <br />Templeton replied that to his knowledge no complaint against <br />the school had ever been made prior to the public hearing on <br />the special permit, but that the school would try to handle- <br />any complaints immediately. ~ <br /> <br /> Ms. Slaughter stated that she felt it was critical to <br />have sufficient buffer, for both noise and visual purposes, <br />but felt that her concerns were adequately addressed in the <br />conditions of the special permit. <br /> <br /> Ms. Daugherty agreed to accept the recommendation to <br />lower the playground levels to 70, but as Rev. Edwards would <br />not accept the amendment, the motion was seconded by Ms. <br />Slaughter. <br /> <br /> Ms. Hopkinson clarified the nUmbers currently enrolled in <br />the schoolt nOting that 25 students are currently housed at <br />another location. Ms. Hopkinson added that the neighborhood <br />had also recommended that fencing be added as part of the <br />buffer, <br /> <br /> Rev. Templeton stated that addition of fencing would be <br /> acceptable and acknowledged that they are only 75 students on <br /> the site at-the current.~time.. · <br /> <br /> The resolution amending a special use permit to.allow <br />expansion of the existing private school and day care facility <br />on Westwood Road, and permit~property to be used fOr church <br />services, with~the numberrof students in the 4 year old and up <br />play areas limited to 70 at a time, was unanimously approved <br />by Council, <br /> <br /> WHEREAS, Northside Baptist Church, on behalf of the <br />owners, Westwood Land Trust, has requested amendment of the <br />special use permit granted to WestWood Land Trust on August <br />15, 1988, and amended September 5, 1989 (copies attached), to <br />allow for the expansion of the existing private school to 240 <br />students and the day care faCility to 125 children at <br />1414-1416 Westwood Road. This property is further identified <br />as Parcels 28.40, 28.41, 28.42, 28.43 and 30.1 on City Real <br />Property Tax Map 44, having collectively approximately 227 <br />feet of frontage on Westwood Road, and Containing · <br />collectively, 111,858 square feet of land or 2.75 acres; <br /> <br /> WHEREAS, following a joint public hearing before this <br />council and the Planning~Co~mission, duly advertised and held <br />on March 8, 1994, this Council findS that such use will conform <br />to the criteria applicable to special permits generally under <br />Chapter 34 of the City Code; now, therefore <br /> <br /> BE IT RESOLVED by the Council of the City of <br />Charlottesville, Virginia that the special use permit granted <br />on August 15, 1988, and amended September 5, 1989 for 1414- <br />1416 Westwood Road is hereby~amended to allow for the <br />expansion of~the existing private school (Northside Christian <br />School) to 150 students and the day care'facility to 125 <br />children. <br /> <br /> The approval off, this special use permit is conditioned <br />upon the following: <br /> <br />1.
