Grantee shall immediately undertake any and all <br />necessary steps, in accordance with applicable FCC <br />regulations, to refund to all subscribers all applicable <br />overcharges based on the maximum permitted basic service tier <br />charge of $8.70, the maximum permitted hourly service charge <br />of $34.22 and the maximum permitted equipment charges <br />identified in paragraph 3 above, together with any franchise <br />fees assessed thereon, plus interest, computed at the <br />applicable published rates for tax refunds and applicable tax <br />payments, which has been overcharged to Charlottesville <br />subscribers since November 10, 1993, the date on which <br />Grantee,s system became subject to rate regulation. <br /> <br /> 5. The City reserves the right to reconsider this <br /> Resolution within one ,hundred twenty (120) days of its <br /> adoption for the sole purpose of further reducing rates should <br /> future modifications to FCC rules and regulations so provide <br /> and permit. <br /> <br />RESOLUTION: SPECIAL PERMIT TO EXPAND PRIVATE SCHOOL AND DAY CARE <br />AT 1414-1416 WESTWOOD ROAD <br /> <br /> Mr. Satyendra Huja, Director of Community Development, <br />stated that the Planning Commission recommended approval of <br />the special permit for the following reasons: 1) It is in <br />harmony with the Comprehensive Plan and Land Use Plan; 2) It <br />will not have a significant adverse impact on the surrounding <br />neighborhood if conditions are met; and 3) The facilities and <br />site as proposed are sufficient to accommodate the proposed <br />use with appropriate restrictions and with future growth <br />approval based on experiences with the recommended level. <br /> Responding to a question from Rev. Edwards about the <br />reaction of the adjacent neighborhood to changes recommended <br />by the Planning Commission, Ms. Phyllis Hopkinson, 102 <br />Westwood Road~ President of the Rugby Heights Neighborhood <br />Association, stated that the neighborhood continues to oppose <br />expansion of the school population as they feel that the <br />addition of the church alone will bring about substantial <br />change. Ms. Hopkinson also stated that the neighborhood feels <br />the current enrollment limits should be reached before the <br />limit is raised and that the number of students allowed in the <br />playground at one time is too high. <br /> <br /> Responding to a question from Mr. Toscano regarding the <br /> rationale for 9:30 p.m. limits on activities on the property, <br /> Mr. Huja stated that it was felt that 9:30 p.m. was a <br /> reasonable limit and was consistent with other schools <br /> reviewed. <br /> <br /> Rev. Bill Templeton, representing the Northside Christian <br />School, noted that the time restriction was not added~as a ~ <br />result of past history. <br /> <br /> Ms.~Daugherty made a motion to approve the special permit <br />and Rev. Edwards seconded the motion. <br /> <br /> Ms. Slaughter expressed concern about the amount of <br />development proposed adjacent to a residential area. <br /> <br /> Mr. Toscano stated that .he shared Ms. Slaughter's concern <br />and was more inclined to move in a more incremental fashion <br />until he was convinced that noise concerns would be addressed. <br />Mr. Toscano stated that he would prefer to lower the number of <br />students allowed in the playground at one time and the overall <br />enrollment. <br /> <br /> Responding to a question from Mr. Toscano, Mr. Huja <br />stated that there are currently 83 children in day care and 99 <br />in the school. <br /> <br /> <br />
