276 <br /> <br />The approval of this special use permit is conditioned upon the following: <br /> <br /> 1. Administrative approval of the revised site plan showing five temporary <br />classrooms, the addition of on-site parking and additional landscaping. <br /> <br /> 2. That the school adopt and confirm a policy allowing student drivers only under <br />extenuating circumstances. <br /> <br /> 3. That the site plan improvements called for in the revised plan, be completed by <br />September 1994. <br /> <br /> 4. That additional screening be provided along the edge of the new parking row <br />along the entrance drive. <br /> <br /> 5. That the ramps for access and connection to the new temporary classrooms be <br />covered. <br /> <br /> 6 That the school, at its expense, continue the use of the off-duty police officer <br />for traffic control during peak hours. <br /> <br />ORDINANCE: AMENDING VENDING ORDINANCE TO ALLOW KIOSKS ON <br />DOWNTOWN MALL <br /> <br /> Mr. Hendrix explained that the two items before Council are an ordinance which <br />would allow larger structures on the downtown mall and a proposed lease for the kiosk to <br />be located near Jefferson National Bank. <br /> <br /> Mr. Lee Danielson, a partner in the proposed kiosk, stated that the kiosk will be of <br />quality construction and architecture and will provide a location for central news vending. <br />Mr. Danielson added that he will appear before the Board of Architectural Review on <br />Tuesday for final design approval. <br /> <br /> Ms. Slaughter stated that she felt Council should hold a public hearing on the <br />proposed kiosk as it is a different practice from that allowed in the past. Ms. Slaughter <br />questioned whether the proposed location was the best location from the City's point of <br />view and added that she felt she needed more time to consider the matter. <br /> <br /> Mr. Steve Blaine, an attorney representing S & L Securities, a partner in the kiosk, <br />stated that a very deliberate attempt had been made to protect the public in the lease <br />agreement, and noted that a lease has not been required for any other sidewalk cafe or <br />vendors on the downtown mall. <br /> <br /> Ms. Slaughter stated that she did not like the right to sublet as provided in the <br />lease, and while she was inclined to allow a permanent structure she still felt that a public <br />hearing should be held. <br /> <br /> Mr. Danielson noted that the timing of the approval for the kiosk is very <br />important. <br /> <br /> Ms. Daugherty stated that if the public hearing is held at the same meeting as the <br />second reading of the ordinance then the project should not be delayed. <br /> <br /> Mr. Toscano stated that he felt the proposed ordinance and lease give a lot of <br />control to the City and he thought the issue of subletting could be addressed. <br /> <br /> Mr. Gouldman stated that the subletting agreement could be subject to using the <br />kiosk for the same kind of use. <br /> <br /> On motion by Mr. Toscano, seconded by Ms. Daugherty, the ordinance entitled <br />"AN ORDINANCE AMENDING AND REORDAINING SECTION 28-121 OF <br /> <br /> <br />
