56 <br /> <br />University Avenue to its intersection with Wertland Street; <br />and Segment (5) - on the north side of University Avenue from <br />14th Street, NW to its intersection with 13th Street, NW; and <br /> <br /> WHEREAS, by notice duly advertised in the Daily P~ogress <br />as required by Section 15.1-244 of the Code of Virginia,~. the <br />Council has given notice of its intention to consider <br />improving such Corner Area in the general manner as described <br />above, and to create a special assessment district comprised <br />of the properties abutting such improvements; and <br /> <br /> WHEREAS, pursuant to such notice, this Council has, at <br />its regular meeting on December 2, 1991, duly conducted a <br />public hearing at which the owners of such abutting <br />properties were heard for or against such improvements; as <br />required by Section 15.1-239 et seq. of the Code of Virginia, <br />as amended; now therefore be it ?~' <br /> <br />RESOLVED by the Council Of the City of Charlottesville: <br /> <br /> A. That the Corner Areastreet scape improvements <br />including, but not limited to~ the replacement of sidewalks <br />and street pavement, in some instances with special paving <br />materials and in others with regular paving materials, the <br />replacement and expansion of facilities for storm water <br />drainage and the installation of lighting, landscaping, <br />benches, waste receptacles and other permanent amenities, is <br />hereby apProved by the Corner Area. <br /> <br /> B. That a special assessment district be created <br />comprising all parcels of land abutting such improvements and <br />that such properties be assessed a portion of the cost of <br />such improvements in the manner authorized by the last cited <br />state code provisions and as more particularly described in <br />the attached Exhibit A entitled "An Abstract of Resolution;" <br />but in no event shall the costs of such assessments exceed <br />fifty percent (50%) of the total costs of the improvements; <br /> <br /> C. That the City Manager, or his designee, is <br />authorized and directed to act on behalf of the city, to <br />contract with the Architects for such additional <br />architectural and engineering services as may be necessary to <br />convert the preliminary designs and specifications previously <br />prepared to a point where the plans can be used to secure <br />construction bidding and final costs for this Corner Area <br />project. <br /> <br /> D. That, if the projected costs of the project <br />following construction bidding do not exceed the estimated <br />costs set forth in Exhibit A hereto, the City Manager or his <br />designee is further authorized to implement this Corner Area <br />project by contracting with the lowest responsive and <br />responsible bidder, and causing the project to be completed. <br />He shall also have full authority to divide one or more <br />portions of the construction work into phases in order to <br />minimize inconvenience on the part of affected owners and the <br />public. <br /> <br /> E. That the City Manager be further authorized and <br />directed prior to commencement of construction of such <br />improvements to close such portion of the streets within the <br />Corner Area to motor vehicular traffic and to take such <br />actions as he may deem necessary and proper to accomplish <br />such closing traffic for purposes of completing this project; <br />and <br /> <br /> F. That the City Attorney is hereby directed to cause <br />to be recorded in the judgment docket of the Clerk's Office <br />of the Circuit Court of the City of Charlottesville an <br />abstract of this resolution in the same or substantially the <br />same form as is attached hereto as Exhibit A, all as allowed <br />by Va. Code Section 15.1-247. Such docketing shall be <br />indexed in each of the names of the owners shown on said <br /> <br /> <br />
