87 <br /> <br /> On motion by Mr. Toscano, seconded by Mr. Vandever, the <br />$39,056.70 appropriation of the drug seizure assets was <br />offered and carried over to the next meeting for <br />consideration. <br /> <br />RESOLUTION: INDEMNITY AGREEMENT WITH LAWYERS TITLE/SOUTHERN TITLE <br /> <br /> Mr. Clyde Gouldman, City Attorney, stated that the <br />resolution would authorize the City Manager to sign an <br />agreement with Lawyers Title and Southern Title which would <br />allow the City to transfer an insurable title when City <br />property is sold. Mr. Gouldman stated that the action was <br />necessary due to a $260,000 judgment lien on City property as <br />a result of the suit regarding Michie Drive. <br /> <br /> On motion by Ms. Waters, seconded by Mr. Vandever, the <br />resolution authorizing an indemnity agreement with Lawyers <br />Title and Southern Title was unanimously approved. <br /> <br /> BE IT RESOLVED by the Council of the City of <br />Charlottesville, Virginia that the City Manager is hereby <br />authorized to sign, on behalf of the City, a contract or <br />similar document indemnifying Lawyer's Title Insurance <br />Corporation and Southern Title Insurance Corporation, in form <br />approved by the City Attorney, from a judgment against the <br />City docketed in Judgment Lien Book 23, page 291. The bond <br />amount shall be approximately Two Hundred and Sixty Thousand <br />Dollars ($260,000.00), plus any applicable legal interest and <br />costs due on such judgment. <br /> <br />~ESOLU~ION: EXTENDING TERMS OF CDBG TASK FORCE <br /> <br /> Rev. Edwards explained that it was recommended that the <br />terms of the Community Development Block Grant Task Force <br />members be extended to May 30th so that their terms do not <br />expire in the middle of the budget process. <br /> <br /> On motion by Mr. Vandever, seconded by Ms. Waters, the <br />terms of all members of the CDBG Task Force were extended to <br />May 30th. <br /> <br />ORDINANCE: AMENDING ZONING ORDINANCE RE: TREE AND SIDEWALK <br />WAIVER/TREE REPLACEMENT POLICIES (2nd reading) <br /> <br /> The ordinance amending Article XXI regarding tree and <br />sidewalk waiver/tree replacement policies which was offered <br />at the February 18th meeting was approved by the following <br />vote. Ayes: Rev. Edwards, Ms. Slaughter, Mr. Toscano, Mr. <br />Vandever, Ms. Waters. Noes: None. <br /> <br />ORDINANCE: GRANTING EASEMENT TO VIRGINIA POWER AT RIVERSIDE PARK <br />(2nd reading) <br /> <br /> Mr. Gouldman stated that Virginia Power had agreed to <br />put all power lines underground and had suggested that a new <br />plat be substituted. <br /> <br /> Ms. Slaughter commended Virginia Power for agreeing to <br />underground the lines. <br /> <br /> On motion by Ms. Slaughter, seconded by Ms. Waters, the <br />ordinance was unanimously amended to substitute a plat and to <br />indicate that the power lines will be placed underground. <br /> <br /> The ordinance granting an easement to Virginia Power at <br />Riverside Park, as amended, which was offered at the February <br />18th meeting, was approved by the following vote. Ayes: <br />Rev. Edwards, Ms. Slaughter, Mr. Toscano, Mr. Vandever, Ms. <br />Waters. Noes: None. <br /> <br /> Ms. Waters asked that the Mayor send a letter thanking <br />Virginia Power for their cooperation in undergrounding. <br /> <br /> <br />
