88 <br /> <br />ORDINANCE: GRANTING SANITARY SEWER EASEMENT RELOCATION (CORNER OF <br />PARK STREET AND PARK HILL) (2nd reading) <br /> <br /> Mr. Gouldman, in response to questions raised at the <br />last meeting, stated that the lot frontage will be adequate <br />for building. <br /> <br /> Ms. Waters stated that while she regretted allowing a <br />building'in this location, she did not feel there was reason <br />to oppose the ordinance. <br /> <br /> The ordinance entitled "AN ORDINANCE TO AUTHORIZE THE <br />ABANDONMENT OF EXISTING SEWER LINE EASEMENT AND ACCEPTANCE OF <br />NEW SEWER LINE EASEMENT WITH RELOCATION OF SEWER LINE ON <br />PROPERTY KNOWN AS 801 PARK STREET," which was offered at the <br />February 18th meeting, was approved by the following vote. <br />Ayes: Rev. Edwards, Ms. SlaUghter, Mr. Toscano, Mr. <br />Vandever, Ms. Waters. Noes: None. <br /> <br />ORDINANCE: CLOSING A PORTION OF LANE ROAD/PARK PLACE AND ALLEYS <br /> <br /> Mr. Satyendra Huja, Director of Community Development, <br />stated that the Planning Commission recommended approval of <br />closing Lane Road, Park Place, and adjacent alleys if <br />conditions are met. <br /> <br /> Responding to a question from Ms. Waters about the <br />timing for phase I drainage improvements, Dr. Jules Levine, <br />Associate Vice President for Health Sciences, stated that the <br />improvements would be done as soon as financially possible, <br />but were at least three years away and perhaps as long as <br />four to five years. <br /> <br /> On motion by Mr. Vandever, seconded by Ms. Waters, the <br /> ordinance entitled "AN ORDINANCE CLOSING, VACATING AND <br />DISCONTINUING LANE ROAD, AND THE ADJACENT ALLEY, AND PARK <br />PLACE AND AN ADJACENT ALLEY" was offered and carried over to <br /> the next meeting for consideration. <br /> <br /> In response to the Planning Commission's comment about <br />waiving payment for the street closing, Ms. Waters stated <br />that she did not feel the policy always required payment for <br />street closings, but rather there must be a public benefit. <br /> <br /> Ms. Slaughter questioned what was originally anticipated <br />but not built with regard to drainage at the Hospital. <br />Dr. Levine replied that he was not aware of any such plans. <br /> <br />ORDINANCE: OPEN CONTAINER ORDINANCE <br /> <br /> Mr. Hendrix stated that the proposed ordinance would <br />make it unlawful to have an opened container of alcohol on <br />any street or park except when licensed by the ABC Board or <br />where allowed in park shelters. <br /> <br /> On motion by Mr. Vandever, seconded by Ms. Slaughter, <br />the ordinance entitled "AN ORDINANCE ADDING A NEW SECTION <br />NUMBERED 17-37 TO THE CODE OF THE CITY OF CHARLOTTESVILLE, <br />1990, AS AMENDED, RELATING TO POSSESSION OF OPEN CONTAINERS <br />OF ALCOHOLIC BEVERAGES IN PUBLIC PLACES" was offered and <br />carried over to the next meeting for consideration. <br /> <br /> ResPonding to a question from Mr. Vandever, Mr. Gouldman <br />stated that the police would be able to take action against <br />offenders and the ABC Board supports the police enforcing the <br />ordinance. <br /> <br /> Mr. Toscano noted that the ordinance would not affect <br />such activities as "Fridays After Five" and questioned <br />whether the police felt the ordinance would be useful and <br />whether they are willing to enforce it. <br /> <br /> <br />
