168 <br /> <br /> Mr. David Spicer, Route 1, Box 129, Milford, Virginia, <br />and co-owner of the property at 224 ShamrOck Road, asked <br />Council to consider questions raised about the proposal and <br />the long-term impact of the sale and development of the <br />property on the neighborhood, adding that he did not feel the <br />decision should be made in such a short period of time. Mr. <br />Spicer noted that the lot was bought for an intended purpose, <br />which purpose has obviously been abandoned~though no report <br />on this has been seen. <br /> <br /> Mr. W. R. Bingler, 500 Hanover Street, representing his <br />mother-in-law who owns property on Shamrock Road, expressed <br />concern about traffic problems and stated that he did not <br />feel Shamrock Road was the proper location for the group home <br />and recommended that the City owned property on the corner of <br />Cherry Avenue and Ridge Street be considered. <br /> <br /> Mr. David Spicer, 2200 Shelby Drive, stated that he has <br />lived on Shamrock Road and has investments in the area and <br />did not think a decision should be made in such~a short <br />period of time. Mr. Spicer expressed concern about the <br />traffic and blind curves on the street and felt that the <br />property might better be used to help the neighborhood, <br />perhaps by using it to straighten the road. <br /> <br /> Mr. Peter Tyree, 767 Prospect Avenue, stated that he is <br />infected with HIV and asked for Council's support for the <br />group home project. Mr. Tyree stated that the house would <br />provide a link between the'community~and the hospital. Mr. <br />Tyree stated that he felt better education on the issue was <br />needed and asked the community not to let fear of the disease <br />block support of the project. <br /> <br /> Mr. Derek Van der Linde, 602 Shamrock Road, noted that <br />the Council has just downzoned property nearby and he did not <br />think there should be a double standard because the City owns <br />the land. Mr. Van der Linde stated that if the City approves <br />the project Council should reconsider its decision to <br />downzone and either follow the Comprehensive Plan or revert <br />to the former zoning. <br /> <br /> Ms. Waters noted that the property is zoned R-2 which <br />allows group homes by special use permit, and added that the <br />zoning of the property is not proposed to be changed. <br /> <br /> Mr. Mark Spicer, 224 Shamrock Road, presented a petition <br />signed by 175 persons requesting information about, and <br />concern with the following with regard to the proposed sale <br />of property on Shamrock Road: 1) The purpose for which this <br />land was acquired by the City; 2) Whether the purpose for the <br />acquisition has been served or abandoned by the City and if <br />abandoned for what reasons; 3) Effect of the proposed <br />construction of low to moderate income residential units and <br />the group home on property values in the area; 4) Had the <br />City considered use of this property as a community park and <br />if so why is this projected sale a better use of the property <br />for the community~ 5) The effect of surface water runoff <br />resulting from development of said property on to the <br />adjoining properties~ 6) Does the City favor a private sale <br />rather than advertising for offers or a public auction; 7) <br />Why there was no notice to adjoining property owners of <br />Council's consideration oft he sale of this property; 8) Has <br />there been a study of the long range effects on the <br />neighborhood of the use of this property as proposed and if <br />not, why not~ 9) Has any study been made on the effect of <br />traffic in the area, particularly on Shamrock Road and the <br />access to said road from the-proposed development; 10) Is the <br />City willing to consider other private offers for this <br />property) 11) Has the City determined that Charlottesville <br />Housing. Foundation has the funds available or the ability to <br />acquire the same for construction of the improvements as the <br />foundation proposes~ 12) in the event Charlottesville Housing <br /> <br /> <br />
