261 <br /> <br />operation was approved by the following vote. Ayes: Mr. <br />Toscano and Mr. Vandever. Noes: None. Abstaining: Rev. <br />Edwards. Absent: Ms. Daugherty and Ms. Slaughter. <br /> <br /> WHEREAS, the Jefferson Area Board for the Aging, agent <br />for the owner of property located at 1512 East Market Street, <br />has requested an amendment to the special use permit granted <br />on June 5, 1989, to expand the hours of operation of the <br />Adult Day Care Center; this property being further identified <br />on City Real Property Tax Map ~56 as parcel 40, having <br />approximately 154.6 feet of frontage on East Market Street, <br />and containing approximately 100,188 square feet of land, or <br />2.3 acres; <br /> <br /> WHEREAS, following a joint public hearing before this <br />Council and the Planning Commission, duly advertised and held <br />on December 8, 1992, this Council finds that certain of the <br />requested amendments will conform to the criteria applicable <br />to special permits generally under Chapter 34 of the City <br />Code~ now, therefore <br /> <br /> BE IT RESOLVED by the Council of the City of <br />Charlottesville, Virginia, that the special use permit <br />granted on June 5, 1989, copy of which is attached hereto and <br />made a part hereof, is hereby amended as follows: <br /> <br /> 1. The facility may be operated overnight and on <br />weekends for respite care for up to a maximum of six (6) <br />adults at any one time; and <br /> <br /> 2. Occasional night time and saturday use of the <br />facility for any other activities shall be allowed not to <br />exceed six (6) times per month. <br /> <br />All other conditions of the initial special use permit shall <br />remain in effect, including those setting regular hours of <br />operation of the day care center from 7:30 a~m. to~5:30 p.m. <br />weekdays. <br /> <br />RESOLUTION: WILLARD DRIVE STORM DRAIN ASSESSMENTS (2nd reading) <br /> <br /> Mr. Gouldman recommended that the resolution be amended <br />to change the interest rate charged to no higher than <br />current one year treasury bills. <br /> <br /> On motion by Rev.~Edwards, seconded by Mr. Toscano, the <br />resolution was unanimously amended as recommended by Mr. <br />Gouldman. <br /> <br /> The resolution entitled "A RESOLUTION AUTHORIZING THE <br />CITY MANAGER TO PROCEED WITH STORM DRAINAGE IMPROVEMENTS IN <br />THE WILLARD DRIVE/CLEVELAND AVENUE AREA," as amended, which <br />was offered at the January 4th meeting, was approved by the <br />following vote. Ayes: Rev. Edwards, Mr. Toscano, Mr. <br />Vandever. Noes: None. ~ Absent: Ms. Daugherty and Ms. <br />Slaughter. <br /> <br /> WHEREAS, this Council has, at a public hearing held on <br />January 4, 1993, considered and agreed to certain storm <br />drainage improvements in the Willard Drive/Cleveland Avenue <br />area; and <br /> <br /> WHEREAS, the area under consideration includes those <br />properties listed on Exhibit "A" attached hereto~ and <br /> <br /> WHEREAS, by notices duly advertised in the ~ <br />Progress as required by S. 15.1-244 of the Code of Virginia, <br />the Council has given notice of~its intention to consider <br />improving the Willard Drive/Cleveland Avenue area through <br />installation of a 30" storm sewer beginning at an inlet at <br />the rear of 324 Cleveland Avenue to just east of Willard Dive <br />at 2500 Willard Drive and installation of a 24" storm sewer <br />across Willard Drive to the end of the existing 24" sewer at <br /> <br /> <br />
