39 <br /> <br />as the lead agency for the purposes of participating in the Regional Competitiveness <br />Program. <br /> <br />RESOLUTION: APPROVING SPECIAL PERMIT FOR AMUSEMENT ARCADE FOR <br />ICE PARK <br /> <br /> Mr. Ron Higgins, Planner in the Department of Community Development, explained <br />that the Council recently amended the zoning ordinance to allow amusement arcade under <br />certain conditions on the downtown mall, and the Planning Commission has recommended <br />approval of the arcade for the Ice Park for the following reasons: 1) It is in harmony with the <br />Land Use Plan of the Comprehensive Plan; and 2) The proposed use will not have a <br />significant adverse impact on the surrounding areas if conditions are met. <br /> <br /> Ms. Richards asked what is meant by "incident experience," and Mr. Higgins replied <br />that the Planning Commission had wanted the language so that the owner would provide a <br />report on the arcade. <br /> <br /> Ms. Richards said that she is concerned about the monitoring and unanticipated <br />consequences as a result of the amusement arcade, but thinks the condition is poorly defined. <br /> <br /> Mr. Gouldman agreed with Ms. Richards, saying that the condition is unclear and <br />implies that the City can do something as a result. <br /> <br /> Mr. Cox said he feels some mechanism is needed to assure that the arcade is not having <br />a negative impact, and asked what the City can do if it is found to have a negative impact. <br /> <br /> Mr. Gouldman said that a clear violation needs to be identified in order for the City to <br />take action. <br /> <br /> Ms. Daugherty said she thinks the amusement arcade will add to recreation downtown, <br />and noted that it will be monitored by the Ice Park. <br /> <br /> Ms. Richards made a motion to approve the resolution granting a special permit for an <br />amusement arcade at the Ice Park, striking condition #6, eliminating the provision that <br />children under 18 not be permitted during school hours, and deleting the word "visually" <br />from condition #3. Mr. Toscano seconded the motion and the resolution was unanimously <br />approved by Council. <br /> <br /> WHEREAS, Charlottesville 2000, L.C., owner of the property known as the <br />Charlottesville Ice Park at the western end of the downtown mall, has requested a special use <br />permit to use a portion of the Ice Park buildings for an amusement arcade, being further <br />idenitified as Parcel 1 on City Real Property Tax Map #28, having collectively 336 feet of <br />frontage on West Main Street, 154 feet of frontage on Water Street and containing <br />collectively 40,794 square feet of land, or .94 acres; <br /> <br /> WHEREAS, following a joint public hearing before this Council and the Planning <br />Commission, duly advertised and held on June 10, 1997, this Council finds that such use will <br />conform to the criteria applicable to special permits generally under Chapter 34 of the City <br />Code; now, therefore, <br /> <br /> BE IT RESOLVED by the Council of the City of Charlottesville, Virginia that a <br />special use permit is hereby approved and granted to Charlottesville 2000, L.C. to use a <br />portion of the Charlottesville Ice Park buildings for an amusement arcade. This approval is <br />conditioned upon the following: <br /> <br /> 1. That the amusement arcade be located in the area shown on the approved site plan, <br />consisting of approximately 1,000 square feet of floor area at the rear of 218 West Main <br />Street and accessed through the Ice Park lobby only. <br /> <br /> <br />
