40 <br /> <br /> 2. That the hours of operation be limited to the hours of operation for the Ice Park; <br />provided that the amusement arcade not operate any later than midnight. <br /> <br /> 3. That at all times during operation, a manager and a minimum of one employee be on <br />duty at the Ice Park to monitor use of the amusement arcade. <br /> <br /> 4. That the amusement arcade not be used for gaming or other activities requiring <br />special state license (such as lotto, or off-track betting). <br /> <br /> 5. That the number of people permitted by the Building Code to occupy the <br />amusement arcade space be posted in the facility. <br /> <br />CONSENT AGENDA <br /> <br /> Responding to a question from Mr. Cox, Mr. O'Connell said that the University no <br />longer plans to construct a road on the closed portion of Park Place and will use the area for <br />a parking garage, parking lot and storm water improvements. <br /> <br /> Ms. Richards noted that the MCI franchise will be extended for six months until such <br />time that the Virginia Municipal League drafts a model ordinmace. <br /> <br /> Mr. O'Connell corrected statements made in the media about the need for the utility <br />rate increase. Mr. O'Connell said that the increase is due to increased cost of operation and <br />debt service on new lines, not as a result of the mild winter. Mr. O'Connell added that the <br />utilities do not support the schools or other capital projects except through a payment in lieu <br />of taxes. Mr. O'Connell noted that the City's utility rates are among the lowest in the state. <br /> <br /> Mr. Cox noted that there are no performance measures mentioned in the Visitors <br />Bureau agreement for evaluating the impact of the substantial increase in funding recently <br />approved. <br /> <br /> Mr. O'Connell said that the Management Committee has discussed evaluating the <br />program, though no specific measures have yet been developed. <br /> <br /> Mr. Cox said he is satisfied having raised the issue of performance measures as an <br />expectation. <br /> <br /> On motion by Mr. Toscano, seconded by Ms. Richards, the following consent agenda <br />items were unanimously approved by Council: <br /> <br />a. RESOLUTION: Authorizing U. Va. Health Sciences Center to make above <br /> ground improvements on closed portion of Park Place <br /> <br /> WHEREAS, City Council approved an ordinance on March 20, 1989 entitled "An <br />Ordinance Closing, Vacating and Discontinuing a Portion of Park Place", which reserves a <br />55-foot strip of land for a future road, and which prohibits above-ground improvements on <br />said land -Mthout the written consent of the City Council; and <br /> <br /> WHEREAS, the University of Virginia Health Sciences Center, contract purchaser of <br />the property on which the subject land is located, wishes to build certain permanent <br />improvements upon and over the 55 foot strip of land; and <br /> <br /> WHEREAS, the City Engineer and the City's Director of Planning have reviewed the <br />University's request and have no objection to the placement of permanent improvements over <br />said land; now, therefore, <br /> <br /> BE IT RESOLVED by the Council of the City of Charlottesville, Virginia, that the <br />University of Virginia Health Sciences Center, its successors in title and assigns, are hereby <br />granted permission to build above-ground improvements over and across that 55 foot strip of <br />land reserved for a future road, as described in an ordinance approved by Council on <br /> <br /> <br />
