48 <br /> <br /> COUNCiL CHAMBER - August 4, 1997 <br /> <br /> Council met in regular session on this date with the following members present: Ms. <br />Daugherty, Ms. Richards (arrived late), Ms. Slaughter, Mr. Toscano. Absent: Mr. Cox. <br /> <br />PUBLIC <br /> <br /> Mr. Steve Stem, 1632 Keith Valley Road, updated Council on the teen pregnancy <br />prevention effort, and said that a grant of $24,000 has been received which will be used for <br />expansion of the part-time Charlottesviile/Albemafle Children and Youth Commission <br />employee. <br /> <br /> Mr. Clinton Walker, 485 Parham Road, said that he thinks the City's curfew is <br />unconstitutional and unfair, and he should not have to be subjected to being hassled when he <br />works late. Mr. Walker recommended that the ordinance be repealed, or at least made an <br />hour later. <br /> <br /> Mr. Kenneth Jackson, 208 5th Street, S.W., expressed concern about the recent <br />incidents of firearms being used in the City, and said he hopes that both the City and County <br />Police Departments will look into the matter. <br /> <br /> Ms. Slaughter said she understands that Albemarle County is doing an update of their <br />gun control regulations, and she has asked the City to look into the matter as well. <br /> <br />ORDINANCE: NOISE ORDINANCE AMENDMENT (car stereos) (carried over) <br /> <br /> Mr. O~Conneli explained that the noise ordinance amendment is aimed at loud car <br />stereos, and will provide a tool to residents and neighborhood groups to reduce noise. <br /> <br /> Ms. Slaughter said that she will allow public comment on both the noise and leash law <br />ordinances. <br /> <br /> Mr. John Selden, Installation Manager of Autosound, said that the problem now is the <br />music which is mostly low bass tones that carry farther distances~ Mr. Selden said that <br />playing this music loud should be considered as a hobby for kids and he feels it is a passing <br />fad. Mr. Selden expressed concern t hat the sound levels will be left to judgment, and <br />suggested that a decibel level be set instead. <br /> <br /> Mr. Kenneth Jackson, representing the Fifeville Neighborhood, support the noise <br />ordinance, and said it is an issue of one person's rights interferring with another person's <br />rights. Mr. Jackson said he t~s the volume is a problem, not just the bass. <br /> <br /> Mr. Roger Clarke, 2126 Lakeside Drive, said that chronic noise pollution affects the <br />quality of life in neighborhoods, and he urged Council to support the ordinance. <br /> <br /> Ms. Karen Kastner, 937 Belmont Avenue, said that noise is one of the major ongoing <br />neighborhood concerns, and she supported the ordinance. Ms. Kastner said that her young <br />children are often awakened or frightened by loud car stereos. <br /> <br /> Mr. Kevin Lynch, 609 Locust Avenue, agreed that others should not be forced to listen <br />to your music. <br /> <br /> Responding to a question from Ms: Daugherty, Mr. Clyde Gouldman, City Attorney, <br />said that the penalty for violation of the ordinance would be a Class IV misdemeanor, <br />punishable by up to a $250 fine. <br /> <br /> Responding to a question from Mr. Toscano, Mr. Gouldman said that similar <br />ordinances have worked fairly well for a number of years in Henrico County and Virginia <br />Beach. Mr. Gouldman noted that few summons are issued, and police have been successful <br />after issuing warnings to offenders. <br /> <br /> <br />
