!21 <br /> <br /> Council reconvened in open session and, on motion by Mr. Toscano, seconded by Ms. <br />Daugherty, certified that, to the best of each member's knowledge, (i) only public business <br />matters lawfully exempted from open rneeting requirements by Virginia law were discussed in <br />the executive meeting to which this certification resolution applies, mud (ii) only such public <br />business matters as were identified in the motion convening the executive meeting were <br />heard, discussed or considered by the Council. <br /> <br /> The meeting was adjourned. <br />President ~' <br /> <br />COUNCIL CI~&MBER- December !, 1997 <br /> <br /> Council met in regular session on this date with the following members present: Mm. <br />Cox, Ms. Daugherty, Ms. P, jichards, Ms. Slaughter, ~.~. Toscano. <br /> <br />PUBLIC <br /> <br /> Mr. Brad Barmh_ili, 109 Shale Place, requested that Council adopt an ordinance !Lmiting <br />the authority of the federal drug enfo_rcement agency as he feels they have no legal authority <br />to operate. <br /> <br /> Ms. Slaughter said Mr. Baw&i!!'s comments wi!! be forwarded to the Commonwealth's <br />Attorney office. <br /> <br />~RESOLUTION: GKANTING SPECIAL PEP_MIT FOP, AMUSEMENT ARCADE AT <br />301 E. MAIN STREET (RAPTURE RESTAUR_ANT) <br /> <br /> Mr. Satyendra Huja, Director of Comrnunity Development, explained that the Pla_n_ning <br />Conmnission recommended that the special permit be approved for the following reasons: !) <br />It is in harmony with the Land Use Plan of the Comprehensive Plan; 2) The proposed use wi!! <br />not have a significant adverse impact on the surrounding areas if conditions are met; and 3) <br />The proposal meets the specified conditions of the zoning ordinance as stated in the city <br />Code, Section 34-464 (8). <br /> <br /> Responding to a question from ~.~. Toscano, Mr. Huja said that the special permit will <br />be valid at the property as long as conditions are met. <br /> <br /> Mr. Toscano asked if there is a computer data bank of special use permits, and _Mr. <br />Huja replied that they are kept by date only, but he will look into it. <br /> <br /> On motion by Ms. Daugherty, seconded by Ms. Richards, the resolution granting the <br />special permit for an amusement arcade at 301 E. Main Street was una.nZmously approved by <br />Council. <br /> <br /> WHEREAS, Townsquare Associates, owner of the property at 301 East Main Street <br />has requested a special use permit to use a portion of the building at 301 East Main Street <br />and 3rd Street, N.E. for an amusement amade. This property is further identified as Parcel <br />231 on City Real Property Tax Map 33, having approximately 48 feet of frontage on East <br />Main Street, 100 feet of ~ontage on 3rd Street, N.E., and containing approximately 7,649 <br />square feet of !and or. ! 8 acres; <br /> <br /> WHEP~AS, following a joint public hearing before this Council and the Planning <br />Commission, duly advertised and held on November 1 !, 1997, this Council finds that such <br />use wilt conform to the criteria applicable to special permits generally under Chapter 34 of <br />the City Code; now, therefore <br /> <br /> <br />
