108 PUBLIC Mr. Roland Young stated that he has been away from the community for some time and upon his return has been disappointed with the state of the black community. On motion by Mr. Towe, seconded by Rev. Edwards, Council voted to meet in executive session to consider appointments to the Monticello Area Community Action Agency Board, to consider acquisition of real estate located adjacent to City-owned property, and to consult with legal counsel. concerning the recent law suit filed against the City by certain Park Street residents and related to the Virginia Power franchise, as authorized by Section 2.1-344(a)(1),(3), and (7) of the Virginia Freedom of Information Act. Following the executive session the Council reconvened and, on motion ~by Mr. Vandever, seconded by Rev. Edwards, unanimously certified that (i) only public business matters lawfully exempted from open meeting requirements by Virginia law were discussed in the executive meeting to which this certification resolution applies, and (ii) only such public business matters as were identified in the motion convening the executive meeting were heard, discussed or considered by the Council. Edwards, Mr. Towe, Mr. Vandever, Ms. Waters. MINUTES On motion by Rev. Edwards, seconded by Mr. Towe, the minutes of the September 13th meeting were approved as presented, with Mr. Vandever abstaining. On motion by Mr. Vandever, seconded by Mr. Towe, the minutes of the September 18th meeting were unanimously approved as presented. PUBLIC Mr. John Deane, a member of the charlottesville- Albemarle Committee for Housing NOW, thanked the Mayor for proclaiming October 7th as Affordable Housing Day. Mr. Tim Lindstrom, Director of the Piedmont Environmental Council, presented the City with PEC's community improvement award given because of the'increased number of flowers planted throughout the City, made possible since the Department of Parks and Recreation began growing its own plants in a greenhouse at Pen Park. Ms. Kay Frazier of the Parks and Recreation Department was recognized as responsible for the award. PUBLIC HEARING: CRITERIA FOR TRUCK RESTRICTIONS Ms. Judith Muel~er, Director of Public Works, reviewed the proposed criteria for designating streets as restricted to truck traffic and noted that staff felt that the percentage of truck traffic should be reduced. The public hearing was opened.
