177 <br /> <br /> WHEREAS, the Virginia ~General Assembly ~in 1989 enacted <br />legislation which allows localities the option of pro-rating <br />personal property taxes; now, therefore, <br /> <br /> BE IT RESOLVED by the Council of the City of <br />Charlottesville, Virginia that the Council hereby approves <br />the concept of pro-rating._personal property taxes as an <br />option and directs City staff to research the issue, make <br />recommendations, and report its findings to Council. <br /> <br />ORDINANCE: CONVEYING CARLTON AVENUE RIGHT-OF-WAY TO CHARNAN TRUST <br />(2nd reading) <br /> <br /> The ordinance entitled "AN ORDINANCE TO AUTHORIZE THE- <br />CONVEYANCE OF A PARCEL OF LAND LOCATED ON THE CORNER OF <br />CARLTON AVENUE AND CARLTON ROAD TO THE CHARNAN LAND TRUST," <br />which was offered at the January 2nd meeting, was approved by <br />the following vote. Ayes: Mr. Buck, Rev. Edwards, Mr. Towe, <br />Mr. Vandever, Ms. Waters. Noes:- None. <br /> <br />ORDINANCE: AUTHORIZING SALE OF PROPERTY AT MONTICELLO/DRUID <br />AVENUE INTERSECTION <br /> <br /> Mr. Hendrix stated that staff recommended that the <br />property be Sold to Mr. Claude Cotten with the requirement <br />that the property remain as an open space, landscaped, and <br />that no entrance be allowed on Monticello Avenue. <br /> <br /> On motion by Rev. Edwards, seconded by Mr. Buck the <br />ordinance entitled "AN ORDINANCE TO AUTHORIZE THE SALE OF <br />PROPERTY LOCATED AT THE INTERSECTION OF MONTICELLO AVENUE AND <br />DRUID AVENUE AND TO AUTHORIZE THE MAYOR'S SIGNATURE ON THE <br />DEED OF CONVEYANCE" was offered and carried over to the nex= <br />meeting for consideration. <br /> <br />ORDINANCE: RETURNING VOTING PRECINCT TO VENABLE SCHOOL <br /> <br /> Mr. Hendrix stated that the ordinance would return the <br />voting precinct to Venable School since the renovations are <br />completed. <br /> <br /> On motion by Mr. Vandever, seconded by Rev. Edwards, the <br />ordinance entitled "AN ORDINANCE TO AMEND AND REORDAIN <br />SECTION 8-2 OF THE CODE OF THE CITY OF CHARLOTTESVILLE, 1976, <br />AS AMENDED, TO RETURN VENABLE SCHOOL AS THE LOCATION FOR THE <br />VENABLE SCHOOL ELECTION PRECINCT" was offered and carried <br />over to the next meeting for consideration. <br /> <br />PUBLIC <br /> <br />There were no matters by the public. <br /> <br />OTHER BUSINESS <br /> <br /> On motion By Mr. Buck, seconded by-Mr. Towe, Council <br />unanimously voted to meet in executive session for the <br />purpose of.consultation with legal counSel concerning matters <br />pertaining to actual or probable litigation or other matters <br />requiring legal advice, and as more specifically described as <br />land use litigation, and for the purpose of considering the <br />acquisition or use of real property for public purpose; or <br />the disposition of publicly held property, and more <br />specifically described as property located in the easuern <br />quadrant of the City, as authorized by Section 2.1-344(a)(3) <br />and (7) of the Virginia Freedom of Information Act. <br /> <br /> Council reconvened in open session and, on motion by <br />Rev. Edwards, seconded by Mr. Buck, Unanimously certified <br />that, to the best of each member's knowledge, (i) only public <br />business matters lawfulty exempted from open meeting <br />requirements by Virginia l'aw were discussed in the executive <br />meeting to whiCh this certification resolution applies, and <br />(ii) only such public business matters as were identified in <br /> <br /> <br />
