262 <br /> <br />Mr. Higgins added that for approval was recommended <br />contingent on the applicant meeting a number of conditions. <br /> <br /> On motion by Mr. Towe, seconded by Mr. Vandever, the <br />special permit for 806 King Street was unanimously approved <br />by Council. <br /> <br /> WHEREAS, Keith Woodard, owner of property located at 806 <br />King Street and Cherry Avenue, has requested a special use <br />permit to develop the property at 806 King Street as a mixed <br />use project with twenty-two residential units and lower <br />level commercial space. This property is further identified <br />on City Real Property Tax Map ~30 as parcels 143 and 144.1, <br />having approximatley 227 feet of frontage on Cherry Avenue, <br />221 feet of frontage on King Street, and containing <br />approXimately 29,304 square feet of land, or .67 acres~ <br /> <br /> WHEREAS, following a joint public hearing before this <br />Council and the Planning Commission, duly advertised and <br />held on April 10, 1990, this Council finds that such use <br />will conform to the criteria applicable to special permits <br />generally under Chapter 31 of the City Code~ now, therefore, <br /> <br /> BE IT RESOLVED by the Council of the City of <br />Charlottesville, Virginia that Keith Woodard is hereby <br />granted a special use permit to allow development of the <br />property at 806 King Street as a mixed use project, pursuant <br />to City Code section 31-33. <br /> <br /> This special permit is subject to the following <br />conditions: <br /> <br /> 1. Administrative approval of a final site plan revised <br />in accordance with all City Code requirements. <br /> <br /> 2. Review and approval of a grading and soil <br />erosion/sediment control plan, with required bonding, prior <br />to site plan approval. <br /> <br /> 3. The required amount of off-street parking shall be <br />provided, with the sizes and dimensions required by City <br />standards. As proposed, the development would require a <br />total of 38 spaces. <br /> <br /> 4. The two parcels shall be combined into one parcel, <br />to avoid internal setback problems and to allow for the <br />proposed density. <br /> <br /> 5. 2,400 net square feet of the total commercial space <br />shall be used for offices, and 2,200 net square feet shall <br />be used for personal services, so that the proposed <br />off-street parking meets City Code requirements. <br /> <br /> 6. The twelve two-story units facing King Street shall <br />be designed and used for low income families as defined by <br />the United States Department of Housing and Urban <br />Development. Otherwise, the units shall not be occuupied <br />unless the off-street parking requirement for conventional <br />non-low income units is met. <br /> <br /> 7. The second floor units shall consist of only six <br />one-bedroom units and four efficiencies. <br /> <br />RESOLUTION: APPROVING ENTRANCE TO MCINTIRE PARK <br /> <br /> Mr. Hendrix explained that the resolution was required <br />by the Department of Transportation. <br /> <br /> On motion by Mr. Towe, seconded by Mr. Vandever, the <br />resolution approving the entrance to McIntire Park was <br />unanimously approved by Council. <br /> <br />WHEREAS, the Council of the City of Charlottesville <br /> <br /> <br />
