294 <br /> <br /> Mr. Gouldman presented two ordinances for consideration <br />by Council. <br /> <br /> Ms. Waters questioned how a long-term commitment to <br />affirmative action can be demonstrated fairly. <br /> <br /> Mr. George Ray, Director of Economic Development, <br />expressed concern that a mandatory requirement of an <br />affirmative action plan might disqualify some businesses <br />which do not have a formal written policy. <br /> <br /> Mr. Vandever stated that if a business does not have a <br />written affirmative plan then one should be developed in <br />order to qualify. Mr. Vandever recommended that "long term" <br />be deleted with regard to the commitment to affirmative <br />action. <br /> <br /> On motion by Mr. Vandever, seconded by Rev. Edwards, the <br />ordinance entitled "AN ORDINANCE TO AMEND AND REORDAIN <br />SECTION 2-118 OF THE CODE OF THE CITY OF CHARLOTTESVILLE, <br />1976, AS AMENDED, TO ADD AFFIRMATIVE ACTION AS A PRIORITY IN <br />CHOOSING RECIPIENTS OF CIDA FUNDING" was offered and carried <br />over to the next meeting for consideration. <br /> <br /> Mr. Buck requested that staff provide options for <br />recognizing situations in the ~ordinance where the affirmative <br />action plan requirement could be waived. <br /> <br />PUBLIC <br /> <br />There were no matters by the public. <br /> <br />OTHER BUSINESS <br /> <br /> On motion by Mr. Buck, seconded by Rev. Edwards, Council <br />unanimously voted to meet in executive session for the <br />purpose of consultation with legal counsel concerning matters <br />pertaining to actual or probable litigation or other matters <br />requiring legal advice, and as more specifically described as <br />building and zoning code enforcement proceedings. <br /> <br /> Council reconvened in open session and, on motion by Mr. <br />Buck, seconded by Mr. Towe, voted, with Rev. Edwards absent <br />for the vote, to certify that, to the best of each member's <br />knowledge, (i) only public business matters lawfully <br />exempted from open meeting requirements by Virginia law were <br />discussed in the executive meeting to which this <br />certification resolution applies, and (ii) only such public <br />business matters as were identified in the motion convening <br />the executive meeting were heard, discussed or considered by <br />the Council. <br /> <br /> The meeting was adjourned. <br />Pre, dent I <br /> <br /> <br />
