293 <br /> <br /> Mr. Towe questioned what effect the ordinance would have <br />on builders. <br /> <br /> Mr. George Ray, Director of Economic Development, noted <br />that the CSX property would be affected since it is not <br />within the parking exempt zone. <br /> <br /> Ms. Waters stated that she felt the ordinance should be <br />passed in order to improve the City's tree ordinance and that <br />if it was found to be a hardship revisions could be made at a <br />later date. <br /> <br /> Mr. Buck stated that complaints regarding the proposed <br />ordinance had been expressed to him and noted that the <br />ordinance had been modified substantially at the Planning <br />Commission's work session. <br /> <br /> Mr. Bill Daggett, a local developer, stated that he had <br />hoped the ordinance would be deferred since the deadline for <br />passage of the ordinance had not allowed adequate opportunity <br />for well thought out discussion. <br /> <br /> Mr. Don Wagner of Great Eastern Management and a member <br />of the Blue Ridge Home Builders Committee, stated that there <br />needs.to be a balance between trees and other plantings on <br />sites. Mr. Wagner stated that he has received complaints <br />from some residents about their property being too shady. <br />Mr. Wagner added that he felt further information was needed <br />prior to adopting the ordinance. <br /> <br /> Ms. Peggy Van Yahres, a landscape architect, stated that <br />the ordinance will clarify what is required regarding tree <br />replacement and preservation. <br /> <br /> Mr. Gouldman stated that he felt the proposed ordinance <br />was more legally defensible than the current one. <br /> <br /> Mr. Stan Tatum~ Chairman of the Urban Design Committee <br />spoke in favor of the ordinance as a means to protect and <br />preserve the City's existing trees as well as extending <br />requirements to areas where they do not presently exist. <br /> <br /> Mr. Buck requested that staff~check~the tree canopy <br />figures which had~been~supp!ied to Council for accuracy° <br /> <br /> The ordinance entitled "AN ORDINANCE TO AMEND AND <br />REORDAIN SECTIONS 26.10-10, 31-190, 31-193, 31-199.1 AND <br />31-205, AND.TO ADD NEW SECTIONS NUMBERED 31-199.2, 31-199.3, <br />31-199.4~ AND 31~199.5 TO THE CODE OF THE CITY OF <br />CHARLOTTESVILLE, 1976, AS AMENDED, RELATED TO TREE PLANTING <br />AND REPLACEMENT" was offered and carried over to the next <br />meeting for consideration. <br /> <br />ORDINANCE: PENALTIES FOR DEMOLITION OF HISTORIC STRUCTURES <br /> <br /> Mr. Gouldman explained that the General Assembly amended <br /> the City's Charter to allow for civil penalties for <br /> demolition of historic structures and the ordinance reflects <br /> this change. <br /> <br /> On motion by Mr. Vandever, seconded by Rev. Edwards, the <br />ordinance entitled "AN ORDINANCE TO AMEND AND REORDAIN <br />ARTICLE XVI OF CHAPTER 31 OF THE CODE OF THE CITY OF <br />CHARLOTTESVILLE, 1976, AS AMENDED, BY ADDING A NEW SECTION TO <br />BE NUMBERED 31-140.3, TO SET FORTH CIVIL PENALTIES FOR THE <br />UNAUTHORIZED DEMOLITION, RAZING OR MOVING OF HISTORIC <br />BUILDINGS OR STRUCTURES" was offered and carried over to the <br />next meeting for consideration. <br /> <br />ORDINANCE: AFFIRMATIVE ACTION CRITERIA FOR INDUSTRIAL DEVELOPMENT <br />AUTHORITY FINANCING <br /> <br /> <br />
