292 <br /> <br /> Mr. Vandever stated that the issue was difficult since <br />both the neighborhood and Planning Commission had been <br />divided over the rezoning. Mr. Vandever added that he ~felt <br />the traffic generated by the business could prove to be a <br />burden to the neighborhood. <br /> <br /> Ms. Waters recommended that in the future neighborhood <br />associations call full neighborhood meetings to discuss such <br />matters and that it be made clear whether representatives are <br />speaking for executive committees or the entire neighborhood <br />on such matters. <br /> <br /> The ordinance rezoning property at the corner of St. <br />Clair and Long Street from R-2 to B-1 which was offered at <br />the June 4th meeting, was defeated by the following vote. <br />Ayes: Rev. Edwards, Mr. Towe. Noes: Mr. Vandever, Ms. <br />Waters. Abstaining: Mr. Buck. <br /> <br />ORDINANCE: REZONING 406 RIDGE STREET FROM R-3 TO B-1 <br /> <br /> Rev. Edwards stated that he would abstain from <br />discussing the rezoning due to a potential conflict of <br />interest. <br /> <br /> Mr. Huja stated that the Planning Commission recommended <br />denial of the rezoning for the following reasons: 1) It is <br />contrary to the Land Use Plan of the Comprehensive Plan; and <br />2) Potential uses in B-1 are not compatible with adjacent <br />uses. <br /> <br /> Mr. Vandever made a motion to deny the rezoning of 406 <br />Ridge Street from R-3 to B-1. Mr. Buck seconded the motion <br />and the rezoning was denied by the following vote. Ayes: <br />Mr. Buck, Mr. Towe, Mr. Vandever, Ms. Waters. Noes: None. <br />Abstaining: Rev. Edwards. <br /> <br />ORDINANCE: TREE PRESERVATION/REPLACEMENT <br /> <br /> Mr. Hendrix explained that effective July 1 localities <br />will be restricted by State law to requiring replacement tree <br />coverage in twenty years rather than the current ten year <br />requirement. <br /> <br /> Mr. Gib Akin, Planning Commission member, stated that <br />passing the ordinance prior to June 30th will allow the City <br />to require more trees to be planted. Mr. Akin added that he <br />was personally concerned about exempting the building and <br />driveway footprint as recommended by the Planning Commission. <br /> <br /> Mr. Buck asked what the reason had been behind wanting <br />to change the tree coverage requirement. <br /> <br /> Mr. Huja stated that the change would provide more trees <br />in the City. Mr. Huja added that if the ordinance does not <br />work Council can amend it at a later date, but can only <br />implement the ten year requirement if acted upon by June <br />30th. Mr. Huja stated that he felt exempting development on <br />parking exempt sites downtown would be desirable. <br /> <br /> Mr. Buck noted concern with the ten year requirement <br />because of the number of trees which would be required to be <br />planted and the eventual size of the trees when they reach <br />maturity. <br /> <br />Mr. Huja replied that trees could later be trimmed. <br /> <br /> Mr. Buck stated that he may be involved in developing <br />property and is required to disclose this possibility prior <br />to voting on the matter. <br /> <br /> Rev. Edwards moved the ordinance without the exemption <br />for the footprint of the building and driveway. Mr. Vandever <br />seconded the motion. <br /> <br /> <br />
